    Hopefully you sent in the Change in Ownership notice to DMV before the accident. That form is a tear away attached to the Title-Pink Slip. If you send it in, you should not be legally responsible for the car. However, if you did not do that, you should try to avoid responsibility based on your bill of sale and other transfer documents.

    Contact your insurance company and lender and notify them in writing about the car being in storage. Give them an opportunity to get it out of storage in other words. The finance company may have purchased collision coverage if you didn't. Collision coverage pays to fix your car and should cover towing and storage. You may have a malpractice claim against your insurance broker if they did not sell you the right kind of insurance.

    Yes you can make a claim to the other driver's insurance, and his employer's insurance. Most employer insurance contracts have higher coverage than the average individual policy, so there should be enough insurance to cover both of you and the necessary treatment. You need a lawyer to guide you through the process. The insurance company has its lawyers on retainer to minimize payment for these types of claims.

    Negotiating a wrongful death settlement is an art and a science. I always meet and talk with all family members, friends, and neighbors, to get a vivid picture of the loss and concrete examples. I gather pictures of my clients with their deceased loved one. The economic loss component, lost earnings for example, can be calculated by a forensic accountant. But the value of lost love, affection, companionship is more difficult to define and requires the assistance of an experienced lawyer.

    There may be liability based on failure to diagnose/delay in diagnosis. Med Mal cases are expert driven...meaning a medical expert must be willing to testify that the first doctors acted below the standard of care. Your medical records should be reviewed by a medical expert to see if there is a viable case.

    It may not be too late. Your jurisdiction may give you time to file a motion to set aside judgment based on inadvertence, mistake, excusable neglect. Consult with a local lawyer immediately.

    He may have a valid claim for liability against the road construction company...probably CalTrans. There may also be a claim for road design defects. He must file a written claim with every responsible government entity within 6 months of the crash.

    Collection attorney; or you can pursue collection through the Small Claims Court. Contact the court or go to the court's website and follow the instructions to bring the judgment debtor back to court for a debtor exam. That is where you ask the judgment debtor about their assets for lien and levy, work for garnishment, and other questions. You should also record an abstract of judgment in all County recorder's offices where the debtor may own real property.

    Best thing is to work out a payment plan with the judgment creditor. Otherwise he can send a receiver to your business to collect your receivables. They may also levy your bank accounts.

    They are entitled to have attorneys. They may qualify of free legal counsel through the state, or through other assistance programs.
