    Best thing is to work out a payment plan with the judgment creditor. Otherwise he can send a receiver to your business to collect your receivables. They may also levy your bank accounts.

    They are entitled to have attorneys. They may qualify of free legal counsel through the state, or through other assistance programs.

  • Total loss I still owe less than what I'm getting from my Insurance how does this work

    I have a total loss I still owe $19,770.00 on my buyout to lien holder. I'm being told by my insurance that there paying 51,990.00 for this claim and my lien holder wants $40,000.00 when the buy is only $19,770.00

    There must be more to the story. Ask for a pay off demand in writing, check the website if the lien holder provides on line account management.

    I would need more information to fully answer this question. However, do not just ignore this situation. If this is just an infraction, then you are probably ok talking with the clerk yourself to get it straightened out. But if this is a misdemeanor or felony case, you should go with an attorney. You can get a public defender if you are low income with little or no assets.

    You can give it a shot, but that may be a tough argument to win. Identification is always important. I guess the argument is they could have your vehicle confused with another.

    First of all, you can contact the US post office and get the forwarding fixed, or apply again for forwarding. You can also put the landlord on written notice of their obligations to return your mail at a minimum, they cannot just throw away your mail. Create a paper trail to protect yourself, and hopefully get some voluntary compliance.

    George’s Answer

    Doesn't sound like you need a cross complaint, but rather an amended complaint. The answer to that question is a lawyerly answer: maybe you can. There are many factors, and I know very little, and closer to nothing about your case and more importantly its procedural status. Generally though, you can file an amended complaint without leave of court if there is no answer on file yet. There may be statute of limitations issues, so don't rely on that right to amend; get it right from the beginning based on the information you have, or can get with reasonable diligence. You will need to do a motion for leave to amend otherwise, and is often only granted if you receive new information. If you named some DOE defendants, you may be able to amend without permission from the court to add a newly discovered defendant or to correct the name and entity status of a defendant. Good luck. It sounds like you need a lawyer.

    Depends on whether they are in different classes of goods as defined by Trademark office. Probably ok but depends on the other company. If they are really big they may challenge and try to oppose.

    Depends on the contract. If your lease automatically converted to month month after the 2 year term, then it should only require 30 days notice to terminate. But maybe there is some special language in your lease.
