    Basically yes. The policy limit appears to be $30,000 per person, up to a max of $60,000 of total paid out to all claimants. If only 2 people are making claims against the policy, then the policy limit will be $30,000 for each of 2 people. Get written proof of the policy limits and an affidavit showing there is no other insurance covering the at fault driver, before you settle.     You should check the Contingency Fee Agreement with your lawyer. Most say the lawyer is not obligated to file appeals without further financial arrangements. Also, a lawyer should not file motions, appeals, etc. that are frivolous, without a basis in fact and law.

    Tell the insurance company to re open. Put it in writing, make a paper trail. Sue the other driver in Small Claims if they refuse and the damage is less than $10,000. You only have 6 months to file a claim with the government if the other driver was a government employee and working at the time. Otherwise the statute of limitations for property damage claims in CA is 3 years.

    It is usually better to loan money to the LLC, have it give you a promissory note, then make the business purchases from the LLC account. The worst thing is to pay personal expenses from the LLC account though. You can lose the liability protections provided usually by the LLC.

    This is a very serious situation that needs your immediate attention. You should hire an attorney to protect your interests immediately. The party may be trying to serve you by substituted service, rather than personal service. This party will most likely claim proper service and try for an adverse order against you.     Referrals from other attorneys or past clients are great. Also try to find out if the law firm and attorney actually go to trial. Many lawyers do not go to trial, but rather settle everything. Usually an attorney with actual trial experience knows best how to prep a case for trial, and thus can set you up for the best settlement.     That should not be a problem, especially since you filed the complete mailing list. But to be safe I would mail another proof of service to all parties with all the recipients listed.

    Yes, try to settle at the CMC; even better, try to settle before the CMC. Maybe the other side will be motivated to settle before the hearing and save the expense and time of going to court.
