  • I Hit a car while i was going home from a bar, sheriff pulled over and arrested me for DUI after i blew the machine and physical

    Test. When i went to the station they didn't run any chemical test and just put me on jail for 3 hrs and let me go. How can i fight this case. This is my first DUI. I never been arrested or get a police ticket before.

    It seems like they may have charged you with a refusal if they didn't give you a chemical test. They sometimes falsely right refusal. If that is the case, you are looking at losing your license for a year. If it is in fact a refusal, you're going to (1) show evidence that you didn't refuse, be it through video that may be available and testimony (2) show through evidence that you were not impaired.

    IMPORTANT TO NOTE, Even if you are GUILTY, you have so many options. Main thing is, getting the surveillance footage if it is available. Go through that and then, work on some kind of defense. If no defense, get your attorney to work on diversion or something. You have a lot of options!

    Best thing to do is go in front of the judge (immediately) preferably with an attorney and explain the situation, bring as much proof as possible and get an order signed allowing your nephew to live outside the county. Also, a hardship would be very helpful!

    First things first, cops will say anything to get someone to admit to something. So, make sure you son doesn't say a word and says he wants his attorney. That will hopefully get the officers to leave him alone. In all likelihood he will be charged with VC 10851 which can be a misdemeanor or felony. Whether it is charged as a misdemeanor or felony, will depend on the facts of the case.

    It is always a possibility to be let out OR, even on a felony DUI with injury. However, do not bail him out until after arraignment if you need to bail him out.
