    It is difficult to find good free bankruptcy help. This is a very complicated area of law that does not seem complicated. Try the bankruptcy court and see if there is a self-help center. They may be able to refer you to someone or maybe there is a large firm that donates a certain amount of hours to helping people in your situation. A lot of good attorneys do that here in Phoenix.     The creditor can list that the property has been foreclosed. It will have a date. This is not a debt collection as much as reporting what is happening. Sell the property in a short sell if you are concerned about credit. The screws a lot of people because the mortgage companies are slow to move on certain properties. Good luck.     I don't know enough about your situation to even know if a Chapter 11 is the best answer. Why can't you file a Chapter 13? It is more affordable and much less complicated.     You have more serious issues than you understand. It is not clear that you are a secured creditor. If you are secured against the property, then you will be ok. No lien and you have big problems.     There is the filing fee and the attorney fees. Don't forget, if you were paying for a car through the Chapter 13, you will have to address the arreages on the vehicle. This surprises many a debtor and then they are stuck without having income and are in a position where they may lose their vehicle. Ask your attorney about the risks of conversion.     Your case will not get dismissed for what you are describing. Normally, a bank account is an asset. In your case, it was a liability at the time of filing. You listed the party who was collecting on the debt at the time of filing. They are the agent of the creditor (whoever it is) and this is considered notice to a creditor. As a side note, this is the least of your trouble. Getting a plan confirmed and making the payments are a much more important aspect of your case. Jim...

    Most of the time, 727 Adversary Proceedings are brought the U.S. Trustee. The standard is very high but not impossible. At a minimum, you should get an appointment with an attorney who has represented others in cases like yours. At least get an opinion as to whether accepting the offer makes sense. There is absolutely not enough information to make a determination regarding your situation. This could go any where and getting an attorney is close to a requirement. Good luck.

    In general, any money put into your bank account can be garnished. The big question would be whether your money meets an exception to the $150 rule. If this was social security, this would be exempt from garnishment. The way you describe this situation is you received money from a bank for relocation. Even if the intended use was to take care of a special needs person, this would not change the nature of the money. In the law you cite, it refers to reimbursement for expenses....

    If you left the ring at the store, the most you should be out - if they sued you - would be the profit on the ring. They can still sell the ring as new as it was not changed and not worn. This is going to come down to whether this looks like a big enough deal to the store. I would be on the watch for them depositing the check again.
