Looks like he may have a problem with his modification. You definitely want an attorney to assist you with this. Sometimes, having an attorney there can make a difference when it comes to a court attributing income to the obligor. An attorney in this case would argue that quitting was a voluntary and unecessary act, especially in light of the depression that we are mired in.

It is her obligation to go forward with the claim if she wants to get child support from you. Absent her attempt to move forward, the husband is the presumptive father. Potentially, you could be on the hook for three years of back child support. If you believe you are the father, I strongly suggest that you consult with a child custody attorney.
