Can I sue my ex-husband for not paying a creditor after his bankruptcy?

Asked by a user in Phoenix, AZ - almost 2 years ago.

Under Arizona law, if the divorce decree orders your ex-husband to pay certain community obligations, that obligation is usually not discharged in bankruptcy. Your ex’s obligation would be considered a domestic support obligation and dischargeable pursuant to 11 USC § 523(a)(14). In short, yes. You can sue your ex-husband for not paying creditors he was ordered to pay in your divorce. Shawn Stone Phoenix Attorney

Can my student loans be negotiated or removed from my credit history?

Asked by a user in Beaverton, OR - almost 2 years ago.

You don’t see student loans being settled too often. If you can prove an extreme hardship, you can try to have the student loans discharged in bankruptcy. The burden of proving an extreme hardship is extremely difficult. You should consult with a bankruptcy attorney in your area for more information on the dischargeability in the context of your particular circumstances. Shawn Stone Phoenix Attorney
