    What I am about to say will depend largely on what court this matter is submitted to. The good new is that it is only charged as a misdemeanor and in a lot of the misdemeanor courts here in AZ (city courts and Justice courts) they do allow telephonic court hearings. The bad news is that you may have to hire an attorney to accomplish this, however the attorney can get your presence waived for the court dates and possibly assist in getting you into the diversion program, which is deferred prosecution.

    With these types of charges it is very important to have an attorney who is skilled in these areas. I assume the new charges are Use of an Electronic Device during a drug transaction, which is simply using a cell phone to set up a drug sale. It does not mean this is what he did, only what they are alleging that he did. Have the family contact an attorney to discuss it further.

    It is my first felony charge and first possession charge? The reason I have a warrant is because I missed my summons to court because I was completing a year long drug and alcohol program in another state.

    You will need to Hire an attorney to set up a court date to quash the warrant and then make argument as to why you missed so that he can keep you out of jail while your case is pending. This kind of thing is common in AZ. Summons' are returned unanswered all the time due to having the wrong address or the individual has moved. We handle these matters all the time.

    For a Misdemeanor DUI the Sate has 1 year from the the time the state is aware that a crime was committed and of course if it has been 14 months then they will attempt to argue that they were not aware of the crime until the blood results came back showing that you were above the legal limit. Obviously as a defense attorney I have argued this in the past and proven that the time began at the time you were pulled over and not when blood results were finally analyzed. If this is a felony then in AZ they have 7 years to file a case against you.

    The major benefit of hiring a private attorney to handle your DUI case is the fact that your private attorney is going to also handle your Department of Motor Vehicle case (if you didn't know it already, you have to government agencies to deal with). The Public Defender will only handle you court case and has no ability to handle the DMV matter. Most private attorneys include the DMV as part of the cost of representing you on the DUI case.

    There should be some very specific instructions in the foreiture notice that you received. Make sure that it is filed with the court prior to the deadline or you will be out of luck.

    If you did not get this paperwork with instructions you should contact the court or an attorney as soon as possible. We have handled numerous forfeiture hearings, an attorney may be very helpful in your situation.

    Unfortunately, the prosecutor can bring charges against the son despite the father "dropping the charges." In my experience, prosecutors take fraud/theft cases like this very seriously especially when other charges may be involved. Hiring a fraud/theft attorney will help to ensure the best possible outcome for those accused. I'd be happy to consult with you further as well.

    Criminal speeding is a Class 3 misdemeanor, punishable by up to 30-days in jail, a $500 fine with a possible surcharge, and 1-year of probation.

    You should very strongly consider hiring an experienced criminal attorney to assist you in this matter. Unless there was a problem with the officer's radar unit, beating this case on the merits will be tough. Negotiating with the prosecutor as a pro per (unrepresented) defendant can also be difficult. This is why it is important to have an attorney who handles these types of cases to negotiate on your behalf.

    I agree with the previous post. Since your warrant is from Iowa, an attorney licensed in Iowa is your best form of representation. They'll know the specifics of domestic assault law in that state and how to move forward. You can search for these attorneys here on AVVO.

    The prosecutor can file new charges any time they want to. Are these new charges linked to your current case or are they completely separate charges from a different set of facts?

    If they are associated charges it is most likely that you case is going to be pushed out by a continuance.
