    The 2013 income is more important than the 2012 income, which is good for you. However, when someone is this close on income, I recommend using a co-sponsor.

    If you don't trust your lawyer, why did you hire them? But what you are describing is correct. There is no filing fee for Asylum, fingerprints are scheduled later by USCIS. There is a filing fee for the work authorization, but that is filed 150 days after the original Asylum application.

    If you are a citizen or legal resident, you can sponsor your spouse for residency with the i-130. However, if they entered illegally, you will need need a 601a Waiver to excuse the illegal presence.

    If you have filed for asylum, you become eligible for work authorization 150 days after the filing of asylum. If you marry the US citizen, they can petition for you to get residency completely separate of your asylum case.

    Currently you can file the waiver from the US and appear at the consulate to get your border pass to re-enter the US legally. The old way required that you leave the country and then file.

    I can answer this question, but I need to know the exact state statute you were convicted under. Theft can be judged as a CIMT and as not a CIMT depending on the statute and facts.

    We have been able to ask the immigration judge to give us long continuances in such cases to wait for a decision from USCIS. If your claim is very strong and it is obvious that USCIS will approve, the judge can administratively close the case.
