I am sorry this is happening to you. Please get a copy of the police report. The officer will have made diagrams and an analysis of what happened. If the report is favorable, use it with State Farm to have them pay for the damages for the case. You can also find the contact information from the 2 witnesses, and they can write out further statements for you. Good luck!

Criminal matters are filed by the District Attorney in the County where the act occurred. Please contact the District Attorney.
You will need to file a "Complaint" with the Court in the county where the damage happened or where the Defendant lives. The Colorado Judicial Wedsite has lots of forms and other information on how to do this. Here is the link for self help. http://www.courts.state.co.us/Forms/Index.cfm.
Arm yourself with facts and continue your negotiation. Search the internet for cars that are similar to yours with similar milease. Go to the Bluebook and similar websites to get valuations of similar cars. Present this information in writing to the adjuster, and negotiate.

Removal is when a case is filed in state court, and the Defendant files paperwork to remove it to Federal District Court. Plaintiffs cannot remove a case. Pendant jurisdiction is when state court claims are filed with federal questions.
