    Rhidian’s Answer

You can always ask for early termination of probation, weather or not this request is granted is another story. As other attorneys stated, get all of your ducks in a row before you make this early termination request so that you increase your odds of having the request granted. Complete all alcohol classes and therapy, do your public service, etc. It is also extremely important that you comply with your monitored sobriety terms, neither missing tests nor submitting positive tests. The court may be reluctant to grant an early termination request on a one year probation term, but it never hurts to try, especially if you have been a model probationer. Good luck.

  • I heard from a source that it is now possible to have an ignition interlock installed on a Motorcycle in Colorado? True?

I have an interlock now in two vehicles, have 1 year left to do.

    Rhidian’s Answer

The DMV decides if you are able to obtain a motorcycle endorsement on your interlock restricted license. The problem there is this: we are yet to find a Colorado interlock provider willing to install an interlock device in a motorcycle.

In a word: no. If you were convicted the DMV will assess the appropriate number of points against you for that charge. The Judge does not have discretion in this area (as s/he does with the fine amount).

It is too hard to speculate as to what kind of plea to expect based on the limited information provided. While prosecutors are not required to make a plea offer, you are likely to be offered something. What the plea offer is will depend greatly on the individual prosecutor, facts of your case, etc... I would recommend speaking with a qualified criminal/traffic attorney in your area about your situation and going from there.

  • If I plead guilty to a misdemeanor for careless driving, is there anyway to appeal my conviction successfully?

I feel that because my lack of knowledge of the law, I was taken advantage of. The only reason I didn't just pay my fine of $150 is because I was out of work for six months and didn't have the money. By the time I did have money it was too late to...

    Rhidian’s Answer

If you entered a plea of guilty there isn't much for you to 'appeal.' However, you can file a motion with the Court to withdraw your guilty plea if you did not freely and voluntarily enter into it. You could also file a motion with the court for a reduction in your sentence, IF you didn't already waive your right to file such a motion when you plead guilty.

    Rhidian’s Answer

You will have a chance to meet with the DA, who will likely ask you if you had insurance at the time of the alleged driving. The DA will also ask you if you have insurance now. If you in fact weren't driving, then you naturally wouldn't have to be insured.

    Rhidian’s Answer

I would highly recommend consulting with qualified criminal and traffic attorneys in the area and hiring one that fits your needs and price range. As other attorneys have already stated, technically your son is facing jail time for these offenses. Further, you will likely find it helpful to have an attorney on your side that can help you navigate the DMV.
