The key to remember is that you are that beginning of the process and the Officer is "going to do what he is going to do". What you need to concentrate on is protecting your rights from this moment forward.

You should contact an attorney immediately to deal with both your DUI Criminal consequences and the administrative DMV consequences. You have seven days from the date of the ticket to contact DMV and try to keep your license.

Your boyfriend will be held in the county jail until his court date. At the resolution of this case he will be sent to immigration and subject to deportation. You need a criminal lawyer for the traffic case and an immigration lawyer for the deportation issue. We handle both.

I was set-up to look like I was a drug dealer by confidential informant who was wearing a wire. She owed my husband money on a loan based on a sale of one of her properties and HVAC work he had done on 2 of her properties. The conversation that ...

    Michael’s Answer

The legality of this incident depends on the legality of the use of the Confidential Informant, which is determined by a number of factors we would discuss. For example, if it can be shown that the informant is not credible or has unreliable information, there may not be probable cause for the warrant and the audio could not be used against you. Furthermore, because the conversation has been tampered with, there may be grounds to suppress the conversation.

    Michael’s Answer

You absolutely have a chance at fighting these chages. Remember that is exactly what they are charges. I would take a picture of the muffler with you to court, take a copy of both your registration and insurance with you to court and see if the DA will drop the charges. If the charges are not dropped immediatly you should obtain counsel in your area to help you with this case.

  • If you have an active warrant in one state, will that warrant show up at the dmv if you go in to get an id card?

I think I might have an active warrant in Alaska. I am currently living in Colorado and want to get an id card. If there is a warrant will it show up at the DMV? I am currently paying back the money for which there may be a warrant (a bad check...

    Michael’s Answer

The short answer to your question is yes your warrant will show up in Colorado. The issue in your case is what type of warrant you have. If they are seeking some type of felony extradition back to Alaska or if it’s some type of misdemeanor failure to pay. Also I have to ask were you ordered to pay by the state (plea deal) or did you take it upon yourself to pay back the money on your own. If you are just trying to pay money back to the aggrieved party I would suggest getting an extradition lawyer in Alaska.

  • My wife had a dui in feb 1999 in alabama, she received another dui in feb 2009 in pa. pa is saying that since this her 2nd dui

in a 10 year period, they also said she refused the breatherlizer test, is there any way she can stay out of jail? the lawyer tells us that 90 days is mandatory and this is what we are trying to avoid

    Michael’s Answer

Assuming a conviction on a second lifetime DUI, you are facing the possibility of 90 - 365 days in jail, one year revocation of your driver's license, over one thousand dollars in fines and costs.

That being said, there are numerous ways to challenge a DUI charge. Remember, you are presumed innocent. Please consult with an attorney, licensed in Alabama, who practices in this field before you speak with the District Attorney.

Also, you have seven days from the date of your alleged offense to request a hearing with the DMV to protect your driver's license.

Best of luck with your case,
