    My learne colleagues are right. Take a copy of the relase and any other paperwork you have to a local personal injury attorney for review. Get a second and third opinion, as well. Then, you will have a pretty good feel if your well-intentioned desire to handle things on your own cost you dearly!

    Tough situation. There are those of us who have litigated cases against carrier for a failure to explain certain things when it comes to isurnace coverage that is available. In your case, however, I am not sure the damages would warrant that sort of claim. You should talk with an attoeny who handles bad faith litigation against insurance carriers to share all of the facts and get the best advice possible.

    Tha is an awful experience. So sorry to read of it.

    All personal injury atotrneys look for oportunities to pursue damages on behalf of their clinets. While none of us "hope for" catastrophic injuries, the fact of the matters is such damages drive settlement values, which in turn, drive wages for an attorney. Any attorney you speak with will look for damages to pursue. Your inconvenience is certainly understood, but I suspect you may find retaiing a personal injury to be a challenge unless you are able to demonstrate gret harm.

    Good question on who gets paid first. I can tell you, having dealt with similar claims in the past, what usually happens is the carrier holds off on settling one until everyone has come to the table as a potential claimant. Than, everyone makes their pitch and turns to their UIM carrier for additional dollars if warranted.

    If you're in this predicament, a personal injury attorney will know how to best pursue any and all available dollars.
