  • Leaving Home of Residency Prior Divorce

    Tomorrow (3 Jun 15), I am filling for my divorce after only 5 months married. We bought a house together and it will be place in the market for sale. Am I safe to leave my home of residency without jeopardizing my rights over the property?

    I would concur with the above, but I would also make sure you and your husband are both on the listing agreement with the Real Estate agent and that you are involved in making decisions on sale price, etc..
    The title company will require both of you to be present at closing so stay informed and hire an attorney in your area to assist you.

  • My brother was not given any sort of BAC test when arrested for DWI. He was pulled over for speeding. Will this help in court?

    My brother was pulled over for speeding and in the process was arrested for DWI. He apparently failed the field sobriety test but was never given any sort of BAC analysis. He was not obviously drunk or obnoxious. Will this help him in court?

    It will greatly help him if there was, in fact, no breath test or blood taken. He really needs to hire someone experienced with DWI defense, and as already stated, he needs to hire someone within 15 days from arrest in order to work on the license suspension issues. Good luck.

    I would contact my attorney and ask them to make a phone call for you to the probation office. There may be something lost in translation and this might all be very "involuntary" and required. Don't make a mistake while on probation.

    Let me reaffirm what David has stated above. You should REALLY consider getting an attorney. You might find legal aid or an attorney that is willing to take a risk that attorney's fees will be paid by your spouse.

    First of all, don't always believe it when someone tells you that men always lose in court.
    I would suggest not listening to her legal advice and calling a professional to get their advice.
    It is possible that she could end up being the one paying child support while you continue raising your child and attending school.
    Seek legal help as soon as possible and get the "real" story.

    If the divorce was filed, there could possibly still be an open file. You might check the jurisdiction or county where the divorce was originally petitioned to see what documents have been filed. This would be the starting point. If the case has not been dismissed for want of prosecution or by one of the parties, you might save yourself a filing fee by reopening the case.

    I would still suggest hiring an attorney to check the file and see what steps need to be taken to ensure the divorce is finalized this time.
