A few mistakes on a report will not get your case "thrown out", however multiple mistakes and other evidence can help with your defense. A capable attorney can attack those mistakes to create reasonable doubt, which in turn could lead to a dismissal or not guilty verdict.

I highly encourage people do be diligent when investigating attorneys. As one poster said, the State Bar website is a great place to search for an attorney and ensure they are in good standing with the State Bar Association. www.texasbar.com Disclaimer of Texas Attorney Although the above response is believed to be accurate, it should not be relied upon as any type of legal advice because the information provided is incomplete. A 17 year old may be considered an adult and many courts would consider her an adult if the parents know where she is and her whereabouts. Does she work, is she out of school is she still attending school regularly? Many factors determine whether she would be considered a "runaway." I would encourage her to stay home and try and help her in anyway you can.

Yes, a court can order a parent to refrain from smoking around a child. Even though the divorce is not final, an attorney can assist you in obtaining temporary orders. In the temporary orders, the court can enjoin (prohibit) a parent from smoking inside or around the baby. If he doesn't comply with this order, he can be found in contempt. I would definitely look for an attorney in your area to assist you with this case.

  5. If a person is on probation in Texas for a 3rd degree felony what sentence is likely for multiple VOP's?

    1 lawyer answer

I would not venture to say what the sentence will be as it most likely depends on the judge and how harsh he/she tends to be on those being revoked. I would say that not reporting is typically one of the main reasons why a person is sentenced to higher amounts of time. As a former prosecutor, I know that not reporting and new arrests are the two main conditions that judges do NOT want to see. I don't necessarily want to guess the exact amount of time (I am assuming here that when you say 5...

DISCLAIMER: You would probably be better served asking an accountant (CPA) this question or a tax expert. That being said: * If you pay medical expenses for someone you do not claim as a dependent on your income tax return, you can deduct those expenses if: o He or she either lived with you for the entire year as a member of your household. o He or she is related to you (a sibling in this situation would qualify). o He or she was a U.S. citizen or...

This case will not be dismissed because of the Sheriff's mistake. You may find an attorney willing to discuss your civil suit and you must be able to show damages, but your criminal case will not be outright dismissed in all likelihood. This would make for great cross-examination questions and could assist you with sympathy form a jury should your case be tried.
