If you have to sue the other driver, your best option may be to file your suit in a small claims court. You could file in either the county where the collision occurred, or in the county where the defendant resides. If you seek to recover more than $5,000.00, you may not be able to file in small claims court. My boyfriend got arrested for a dui. he is currently on probation and has been for the past 3 years. what is the likely outcome

Since your boyfriend is already on probation, the prosecutor will most likely seek to revoke his probation. It is easier to revoke someone's probation than it is to obtain a conviction on the new charges. If they successfully revoke his probation, depending on how much time he has to serve for his revocation the prosecutor may decide to sit on the new charges and not prosecute him. If your boyfriend can't afford an attorney, a court appointed attorney is the best solution.
