There should not be an immigration hold on your brother, unless the immigration bonds have been revoked. You should try to find a local criminal defense lawyer to assist you in this matter. It is impossible to tell if your lawyer is doing a good job or not. It is possible that the delay is a reasonable delay based on the specific circumstances of your case. An affidavit of non-prosecution (ANP) COULD result in the case being dismissed. So the ANP could have a huge result. Ultimately the decision of whether to prosecute the case will rest with the prosecuting attorney. You should speak with your boyfriend's attorney about your options. Good Luck!
