  • I had a rental car catch fire while I was driving and suffered 2nd degree burns do I have a case?

It was a rental from enterprise caught fire while I was driving

    Lannie’s Answer

Depending upon the cause of the fire, you may have a case against either Enterprise or against the car manufacturer. Hopefully, you are not injured badly enough to warrant the expense of a case against these corporate entities, but if you were, then you should seek legal help very soon so that the car can be preserved and examined by burn experts.

  • I was hospitalized for 40 days post motorcycle/truck accident. My care has brought many questions. I'll list a few below.

My medical records have me listed as Hispanic, 286 pounds, 5'10". Iam Caucasian, 230 lbs and 6.0". 230 lbs is the heaviest weight my entire life. Also, I had an IV infiltrated that caused build up of fluids and severe swelling at the IV site. A...

    Lannie’s Answer

While it sounds like there may have been some medical neglect, it may be best to pursue this as part of the damage model from the vehicle collision. The issues that you point out are common in these types of cases, and are very frustrating, but not insurmountable. I would take them to a competent attorney and go over the details of errors in the medical chart. Your help in pointing out these errors, and the ease with which they can be shown to a jury may very well make the difference in this case.

  • Can I sue a cosmectic surgeon for a procedure that turn into an infection and had me hospitalized for 7 days and 2 surgeries?

I had a fat transfer procedure done to my breast , 9 days later I suffered from a infection and had to go to the hospital where I had 2 surgeries right a way. I am currently in pain constantly from areas where the fat was removed and placed.

    Lannie’s Answer

I agree with John Zgourides about the difficulty with these cases now. They are very expensive, and require detailed analysis by expert physicians. Also, infection cases are very difficult because infection is a known risk of most surgical procedures. While you should talk with a medical malpractice attorney, you should know that Republicans have been working hard to defeat your case with unfavorable "tort reform" laws well before you were ever injured.

If there is liability here at all, it probably falls on the dojo. However, I would not risk it, and would contact your homeowners coverage to avoid any personal financial risk.

    Lannie’s Answer

Pain and suffering damages are now capped in Texas due to the Republican-led "tort reform" movement. You should talk to a medical malpractice attorney to see what, if any, rights you have left.

  • Do i need a personal injury attorney

While in Ft Worth for work (TDAmeritrade) I was attacked in a bar (Joe's, La Scala-Westlake) and sent to the hospital with a laceration on my head and a concusion (they also completed a CT scan). The police came but no witnesses wanted to come fo...

    Lannie’s Answer

Assault cases against bars are difficult to sort out at times, but if the evidence supports your version of the facts, as you set forth above, then you are likely entitled to some compensation - particularly if there is a history of this type of activity at the same location. You need to seek an attorney's help.

    Lannie’s Answer

Cases involving prior injuries will be undervalued by the insurance company. You will need a lawyer to navigate the maze that they will throw in front of you. I agree with my colleagues, DO NOT GIVE A STATEMENT to their insurance company. They are NOT YOUR ALLY.

I agree with my colleagues that if you have been injured you should seek an attorney's assistance. Of course, that includes your unborn child as well. The fact that the driver fled the scene is a particularly egregious fact in this case.

    Lannie’s Answer

Some of the nuance to your question include the size of the company, and the specifics of the statements or comments that he is making. It sounds like he is suggesting a quid pro quo exchange (promotions for sex), but it is unclear whether he has that authority based on your inquiry. I agree with my colleagues that you should speak with an attorney about this.
