The fact that your son was rear ended will help in your claim against progressive. The down side is that Progressive knows it will be hard to find an attorney to represent you on property damadge alone unless you are wiling to pay an attorney hourly. This is the type of case you may want to take on your own to JP court. In Texas, JP Courts have $10,000. 00 juridictional limit. If you have health insurance use it. The hospital will give your & you a better deal on the bills. If you use the other drivers insurance you will be taking away from your settlement because the Hospital will charge a lot more than they normally would to health insurance company

Generally attorneys take 33% plus expenses before filing a lawsuit or 40%plus expenses after filing a lawsuit. However, there is no hard fast rule. It depends on the difficulty of the case and the attorney involved. An attorney and client can reach there own agreement. Good Luck

Unless your daughter was driving your auto insurance does not cover this situation. Tell your health insurance company that they have a subrogation interest not a first party claim. They need to insure you and worry about collecting later. If you have any other questions please feel free to call my office.

Your recovery will be based on your injuries. What were your boyfriends injuries? Without this information, your question can not be answered.

If it is property damage only then my next question would be if your insurance covered the vehicle? If so then you do not own the claim anymore your insurance company does. The statute of limitations in the state of Texas is 2 years. If you have not brought a lawsuit you are out of luck. Sorry to be the bearer of bad news.
You will have to pay the judgment or work out a payment plan with the state.
You shouldn't have to pay a higher premium because of fraud. Unfortunately, due to your insurance contract you have no control over the action your insurance company takes. I would make sure you give your insurance company has all the evidence you have about the fraud. Do it in writing. Get with the adjuster an make sure he/she knows your feelings. That's about all you can do. Good luck.
First, I hope you or your family were not seriously injured. Your insurance company will look at the factors that caused the accident. How badly you or your family were injured. How much time you missed from work. There are many other factors the insurance company may take into consideration. If you need any help please give me a call at 512-407-8800.
