DWIs stay on your record for life in Texas. Therefore, this should be a 3rd degree felony. The fact that you were hit, while unfortunate, will not keep you from being charged. If you had a passenger and he or she was injured or killed, it would keep you from being charged with DWI with injury or Intoxication Manslaughter.
