    What the other attorneys are talking about is the "discovery rule" which would allow the Statute of Limitations to be "tolled," but only on limited circumstances. A medical malpractice case is a "deviation" of the standard of care. Only with the medical records would be able to give you proper legal advise.

    Generally speaking, she can sue the driver only; however, there may be some exceptions to that rule, if the other passengers were somewhat negligent in causing the accident or the damage to the car.

    She willingly gave her keys up, she was not driving or anywhere near the car, she does not have insurance and its not the first time she gave the car to the driver.

    In general, liability of a car accident is not determined based on who gives permission to use the car, but who the driver of the vehicle is. There could be exceptions to the rule, but I will not talk about them here. If I understand your question, you want to know who would be more responsible here?

    Did your husband hit the other vehicle or the other vehicle hit your husband's? When was the accident? Do you have your own insurance? How much damage to the vehicle?     If the child support that you pay goes through the Attorney General's Office, you already have an order adjudicating you the father; otherwise, you have to file a SAPCR in court in order to do that. Good luck and God bless you!
