    The problem here is that he has figured out the AG system -- if he pays something every month they stay off his back. You will need to hire a private attorney who will file contempt of court. A judge who hears the case will give him an opportunity to catch up and when he doesn't, will throw him in jail. That will get his attention. The AG has over 1 million cases in their system. Don't blame them. Attorney's fees are mandatory in these cases so you may be able to find someone who will take this...

    If you have not had any children in the last 10 years and have not accumulated any property the divorce can be really easy. Harris County has a volunteer attorney program that can help you. If you have given birth to a child (not your husband's) or have any property (house, car, retirement) it is more complicated and you need a lawyer. Good luck.

    You do not say whether the paternity suit has been finalized. If so, the father is the next person to take the child. However, if he does not feel he can raise the child, it is in the best interest of the child to place him/her with a family member who can raise the child and give the father visitation. He will have to pay child support so perhaps he needs to be looking for a more regular job. My sympathy to you in this tough situation.

  4. Can my wife file for back child support for children 33 and 24 years of age?

    Your wife cannot get back child support. I hope you were supporting your children from the time of your separation so she cannot use that against you. The law says retroactive child support is limited to filing before the child's 22nd birthday.

    You owe back child support for the time period they were not emancipated. If you can prove the children were emancipated before 18 or high school graduation -- married or in the military -- the child support obligation ends. Some judges on a case by case basis will end the child support if you have proof the child is living on his/her own and self-supporting. That will not wipe out all of the support so you need to start working to pay what you definitely owe and then worry about what you may...

    The current support will be reduced if his income has dropped and the child support guidelines under the Texas Family Code merit a decrease. However, your monthly payment might stay around the same because he still owes you arrears and those must be repaid. There is no forgiveness of back child support in Texas and interest is mandatory.     In Bexar County (San Antonio) the courts and the clerks do not provide forms. They are prohibited from giving legal advice. In some counties in the state you can buy form packets from the law library. If you have no children and no property you can probably do your own divorce by following the online instructions.     If the order says he is ordered to reimburse you for your cost, you can file a writ of withholding or an employer's order to withhold the amount from his paycheck in addition to your child support.     Your friend can file for divorce in Houston but needs to contact Legal Aid or the Harris County Bar Association to find a pro bono lawyer.     If you know where he is, call the Montgomery County Sheriff's office and tell them he has a warrant for his arrest and tell them where to find him. Many times they can go out and pick him up. The Attorney General does the best they can but they have over 1 million cases in their system. Give the AG any information you get on him.
