Dear Defendant, The Short answer to this question is probably not. They have the right to sue you and obtain a judgment for the $4,000.00 but chances are that they will not be able to collect on said judgment. If Texas law governs your contract (i.e. the terms of the contract stated this or the contract was signed in texas) then the statute of limitations begins to run after your last payment on said account.
