If my vehicle was hit by a driver excluded from the insurance policy of the car he was driving.

Asked by a user in Porter, TX - almost 3 years ago.

If he has no insurance, it will be difficult for you to recover anything on the case. You may try to determine if he has his own car. If he does, his insurance may still cover him when he drives another vehicle. The other option would be Uninsured motorist coverage. If you do not have it on your policy, try checking with family members that live in your same household. Their UIM insurance will often cover you if you don't have it on your policy. Your last options would be to pay an...

I am currently employed however have been under systematic character/professional and career defamation in the workplace

Asked by a user in Austin, TX - almost 3 years ago.

Employment law is pretty tough in Texas. To give an accurate answer, I would need a little more information. First, what is being said about you? Who is saying it and in what capacity? Who are they saying it to? Are you being discriminated against base on race, sex, religion, national origin etc.? Has it hurt you financially at this time? These are just some of the issues that would need to be addressed to give a more complete answer. The short answer is that your options may range...

I loaned my car to a friend who totaled it. What are my rights in being able to recover any money ?

Asked by a user in Magnolia, TX - almost 3 years ago.

Check and see if your friend was covered by auto insurance policy at the time of the wreck. If she was, it should cover for damages she caused while driving your vehicle. The next option would be to file on your own insurance if you have collision coverage. The last option would be to file suit against your friend. The downside to this option is that it may be difficult to collect any recovery if she is not covered by insurance.

My car was damaged by a U-Haul and I need to know the statue of limitations and what I need to ask for when summitting damages?

Asked by a user in Tyler, TX - almost 3 years ago.

The statute of limitations is generally two years from the date of the accident. Unfortunately, it is not unusual for people in your situation to get the run around, but you do have options. Option #1 Play the game, keep getting them what they want and eventually they should make an offer. Option #2 Get a lawyer of file suit in small claims court. Depending on the amount of damages it may or may not be economically feasible to get a lawyer. If you can't afford a lawyer or find a...

Asked by a user in Austin, TX - almost 3 years ago.

Respondeat Superior is a fancy legal term that stands for the proposition that an employer is liable for the tortuous conduct of their employees when the employee is acting in the course and scope of their employment. In plain language her employer would be liable if your wife was at fault in an accident while on the job. Your wife would also be individually responsible for her own conduct. The legal term for this in joint and several liability. Your wife and employer would jointly...

Other person at fault in car accident

Asked by a user in Dallas, TX - almost 3 years ago.

I am handling a claim involving thoracic outlet syndrome and know how difficult it can be to deal with. I would recommend that you contact an attorney. If you have a significant injury, it will be difficult to get a reasonable settlement without filing suit. If the wreck occurred in Texas, you have only two years to file suit.
