I think the ex is just talking and likely won't take any action. You may want to be prepared with an attorney ahead of time if in fact he does show up. Good luck!

The reality is you are not going to likely be able to get CPS to work with you quickly on anything if you don't have an attorney.

I agree with Alexis. Have you tried offering assistance to your ex? It would seem to me a reasonable person would not want his son to be homeless especially during the holidays.

  5. Is there any legal way, in the state of Texas, for a minor to move in with a step-parent with the consent of only one parent?

    Answered over 2 years ago.

    1. Shari Goldsberry
    1 lawyer answer

Minor's step-mother probably should have filed a petition while still living with the minor to secure visitation rights. Depending on how long it has been since your divorce, you may still be able to. Consult an attorney.

I suspect there is more to this story than this. The attorney is probably bluffing. I would be surprised if you ever actually get sued.

  7. Can CPS falsify documents?

CPS can be very frustrating. If you find an error in the documents I would write my caseworker and ask them to put a note in the file that you disagree with the specific information contained in the document. They likely won't be able to remove the error because that's not how their system works.

Offer to have them come live with you and if that offer is accepted, after six months, you will have standing to bring a suit for custody. Good luck.
