    Description:
    Defended two Houston attorneys sued for legal malpractice stemming from their handling of a complex shareholder oppression case. Prior to my representation, attorney clients had lost the largest jury verdict in the United States in 1998 ($1+ billion). That underlying case was reversed and rendered to zero on appeal. Shareholders then filed a new derivative lawsuit alleging attorney clients had failed to protect shareholders' interests in a $20 million dollar settlement. Successfully prepared, argued and won summary judgment for both attorney clients in the trial court; the case has just been affirmed by the Court of Appeals. The case will be published in July of 2008; a citation will be assigned at that time.

    Description:
    Double Wrongful Death Dramshop Lawsuit brought by plaintiff children who watched their parents run over and killed by a drunk driver last known to have been drinking in client's bar in Galveston, Texas. Successfully defended the owners and operators of the bar. Successfully challenged scientific testimony of plaintiffs’ Forensic Toxicologist. Trial court struck plaintiffs’ expert’s opinion and granted summary judgment for the client; the trial court’s decision was upheld on appeal in a published decision. Alaniz v.     Description:
    Represented Dixie Stevedores when a seriously injured plaintiff filed a million-dollar lawsuit against client and the Port of Houston. Jury verdict for approximately $1 million dollars found client five percent responsible for accident and Port 95% responsible. Client’s portion of the verdict was reversed and rendered to zero on appeal to the Texas Court of Appeals in a published decision. Texas Supreme Court then made new law on how the Texas Tort Claims Act‘s damage caps apply to the Port of Houston in a published decision.Court of Appeals case cite: Port of Houston Authority v.     Description:
    Defended a paving subcontractor in a commercial construction arbitration filed by the owner of a local storage facility. Business owner claimed $500,000 in total damages but was awarded only $10,000 by the arbitration panel. Plaintiff business owner then filed suit to set aside the arbitration award; defeated plaintiff’s attempts to set aside the arbitration award at trial and on the appeal in a published decision.
