The Insurance policy is from California and in that state the Insurance Company has 40 days to accept or deny coverage or they must put in writing to Insured driver that they need more time to investigate. Insurance Companies have a right to deny a claim if their Insured does not talk to them about accident. This was never used in the past, however insurance companies seem to be using this provision all the time. If you know where he is, either send a letter or have someone make him contact...

You can go to Police station and fill out the "Driver's Crash Report", also known as "Blue Form", or follow this link http://www.houstontx.gov/police/pdfs/AccidentRep08.pdf I believe you should always have an official version of the accident on file. This will help you with your claim against the Drivers Insurance Company. If you can't get the claim resolved yourself contact a lawyer. I would have the report amended, by contacting police department because you could have a citation filed against you or a criminal charge of hit and run. It also could have an effect on your car insurance rates, because you were found at fault in a car accident.
In Texas the only way you can be successful suing a public school is if the child is injured in a bus accident or the child is injured by a teacher hitting them. The school is immune from liability for all other actions. I would contact the Superintendant of the school and the principle to insure their is a system in place to prevent this from happening in the future.
