My husband just went to jail and i have an AOS interview what do i di?

Asked by a user in Southfield, MI - almost 2 years ago.

A key question here is who is the US citizen, you or your husband? If it is you, then that makes this more complicated since your husband, the immigrant, has a criminal record that has put him in jail for 14 months. I would hire an immigration attorney, if that is the case. If he is the citizen, it is less complicated and then you could attend the interview by yourself and give them proof that he is in jail and can't attend. You must bring a lot of proof of the bona fides of your marriage...

How soon can an immigration attorney start working on a hold if county has sentenced inmate for thirty days?

Asked by a user in Las Vegas, NV - over 2 years ago.

You could start looking for and working with an attorney right now. In 30 or less days, your husband will most likely be give a Notice to Appear and soon afterwards, put before a judge. An attorney can tell you if he qualifies for bond and if so, you would want to go for the bond proceedings to get our husband out of detention and to go through immigration court while out of detention. Their is an immigration court in Las Vegas. It depends on where they will transfer him to after his...

I am a citizen. my wife moved to the us 12 years ago. she currently has a ss# but does not think she is a citizen. what can i do

Asked by a user in Houston, TX - over 2 years ago.

Until the last few years, many people without status were able to procure a driver's license, social security number, and many other forms of identification. Recent laws in Texas have made it more difficult. I highly suggest consulting with an immigration attorney directly because there is a lot of information that is necessary to ascertain whether she is a US citizen, and if not, how to get her paperwork started towards legal permanent residency. If your wife wasn't born in the US,...

My brother was arrested; his bail was paid to the county but INS placed hold on him right before his release. what do I do?

Asked by a user in Houston, TX - over 2 years ago.

You need an immigration attorney in Houston with removal/deportation experience ASAP. Depending on the form of relief, you can try to get him out on bond from the immigration detention. It is helpful he entered legally but the attorney needs to know more. There is most likely nothing you can do to get him from being sent to immigration detention. It will be important that the burglary be dropped. That is wise you told him not to sign the voluntary order of deportation before...

My husband and I have been married for 3 yr. and we have a 6mo old i have petitioned and he has been approved what is next

Asked by a user in Bonham, TX - over 2 years ago.

There are a few questions that an immigration attorney would need to ask before answering your question. -Did your husband enter legally? - When was his sister's I-130 approved? - if he entered illegally, has he ever left the US? Basically, the question to be determined is if he must return to his home country to complete the process or if he can remain in the US. This can be figured out by a few questions including those listed above. I highly suggest you consult with an immigration...

I want to know if certain factors will help me when I reach the point where I have to submit an I-601?

Asked by a user in Houston, TX - about 2 years ago.

From experience, I highly suggest you contact an immigration attorney about this process. It is far riskier to do this process without someone with experience and so much is at stake. You have a lot of equities to work in your favor. My firm has extensive experience with consular processing and waivers. Feel free to contact me regarding my response. How can i tell if i ever signed a Voluntary Departure G-146 form

Asked by a user in Houston, TX - over 2 years ago.

It would help to know why you think you might have signed it. If you think there is a chance that you did, you might want to do a Freedom of Information Act request for copies of your file. This could take a few months though and it appears you have an interview coming up soon. You might want to consult with an attorney about this to be sure. I am engaged to an illegal immigrant that is living in the US. He wants to become legal, what should we do?

Asked by a user in Houston, TX - about 2 years ago.

I would like to follow up with the other attorney's response. It appears you are located in Houston, TX, where my firm is based. In Houston and Texas, your fiancé has a high risk of being found and deported. I would suggest you consult with an attorney about your matter sooner than later because waiting can make it more complicated and more costly. Additionally, you didn't mention where your fiancé is from but if he happens to be from Mexico, Mexico has a pilot program for waivers. In...

My husbond is in the usa with out permission can i get him legal with out him going back to mexico.

Asked by a user in Abilene, TX - over 2 years ago.

The only way he wouldn't need to go back is if he is eligible for 245i which basically means someone petitioned for him a while ago and he can adjust inside the US. Most likely, you will need to start the consular processing process, have him return to Mexico, and apply for a waiver in Juarez before he can return and have legal status in the US. **Please discuss your case with an immigration attorney before you proceed and especially before your husband returns to Mexico, which will...
