  • Mediation - 9/30/08

    Practice Area:
    Mediation
    Outcome:
Partial settlement - 3 issues to go before Judge
    Description:
I mediated a child support/child visitation case between 2 people (each married to someone else!). They had 2 children (ages 4 & 2) together. Both parents were trying to save their marriages to their current spouses. Lots of emotional issues were apparent. Unfortunately, I was unable to resolve every issue. However, we were able to agree on Joint Managing Conservatorship (w/ Mother as primary within Harris & contiguous counties) with all rights and duties independent for both parents. DNA had been done 6 months ago on the 2 children. Father offered $10,000 in retroactive child support, but Mother wanted over $30,000. We were less than $100 apart on current child support. We mediated from 5-9 pm at my office and I served pizza.

Couple had 3 children ranging in age from 16 - 10. Oldest child ran away from Mom to live with Dad. Youngest child was severely handicapped. Many issues involving unresolved anger of both parents. I was able to resolve all issues but one. I predicted with the Judge would do but neither party was willing to negotiate. PS - The Judge did was I had predicted!
  • Latest Do It Yourself Kit

    Practice Area:
    Family
    Outcome:
    Divorce in Progress
    Description:
Wife emailed me regarding my DO IT YOURSELF DIVORCE kit. The couple came to see me for a consultation ($150). They were in counseling and were trying to make their marriage work. There appear to have a lot of unresolved emotional issues. Neither were from Texas and they did not understand Texas divorce law. I answered their legal questions. A month later they contacted me again. Counseling was not working. I encouraged them to continue while their divorce moved forward so that they could communicate in a "safe" environment. They wanted to proceed with my DO IT YOURSELF kit. Both of them were comfortable with me helping them with their divorce paperwork. Wife keeps the books so she knows where all the money goes. Husband has 3 small businesses. They are currently working out their financial division so it will not impact their children & their lifestyles. The children are in private school & involved in many extra-curricular activities. Husband has moved out of the home. Both are complaining about the high costs of running 2 homes! However, both want to make sure their children are not impacted by this divorce. They want to proceed slowly as they watch the economy & their businesses.
  • Modification

    Practice Area:
    Family
    Outcome:
    Client was extremely satisfied
    Description:
At a temp. order hearing, petitioner's attorney wanted child support to increase from $550 per month to $750 per month. Respondent came to see me. After reviewing his 2009 paystubs, his income dropped significantly from 2008 to 2009 because his overtime stopped. I was able to negotiate child support to $580/month with opposing counsel without a court appearance.
  • Harris County, Texas A G case

    Family
    Outcome:
TX A G actually let me set a hearing for a Monday!
    Description:
A man in other state called his former kung fu teacher & got my name. We've done everything via phone, email & fax. I went to court. Ex-wife did not show. I reset for a MONDAY in JUNE. They usually do Wednesdays but since he's coming in from out of town, they ACTUALLY WORKED WITH ME. I gave them his paystubs and they made me copies of everything in the file for free without me having to order certified copies and pay for each page. My client is so relieved and thankful that he hired me.

  • 2 Recent Cases involving "bogus" collections

    Practice Area:
    Debt Settlement
    Outcome:
Helped 2 people with small claim cases
    Description:
I've had 2 recent cases regarding collections. One was a very old debt. The man hired me and I filed an Answer. Once I got involved the attorney never appeared in court and the judge dismissed due to statute of limitations had run years ago. I think they were just trying to "bluff" him into paying a "bogus" debt. Another lady got a nasty letter from a collection company regarding a sub-contractor that left a job incomplete and disappeared. He wanted almost $7,000. No written contract. This man had "trashed" her home - saw the photos & had 3 other unhappy neighbors where he'd left their homes worst than he found them. One phone got the amount reduced to $1,000. I told the "collection agent" that if they persued this matter, she would counter-sue for the $5,000 she's paid to "fix" his shoddy work. So far this "collection agent" has stopped harrassing the lady. Hopefully these "bullies" will go away!

One father was in prison & was not involved in this mediation. One father was granted visitation after his recent release from prison & was given hope that he might get custody in the future. Divorce & Separation
    Date:
    Nov 02, 2012
    Outcome:
    Case Resolved
    Description:
Child custody, child support & divorce case involving 3 minor children. Attorney warned me in advance that this was going to be an difficult mediation. Two of the 3 children attended mediation to speak to me. Before the mediation was over, the 2 kids were going from room to room visiting with their parents -- something I was told would NEVER happen! At the end of the mediation after the paperwork had been signed, the parents were cordial in the reception area, again, something I was told would NEVER happen. Both parties were very satisfied with the settlement reached in this mediation. I resolved the case in 4 hours - speed mediation!
