Dr's saying they will report me to CPS unless I agree to a CT Scan & full skeletal xray for my 7 month old

Asked by a user in Austin, TX - 4 months ago.

I suggest that you contact an attorney immediately! It seems obvious that the Dr. is looking for evidence of past abuse. I suggest that you demand a copy of your child's records as well as an explanation as to why they the Dr. is requesting that you do this. It is more than likely that the Dr. has consulted with a specialist. Austin's Dell Children's Hospital is at the forefront of investigating abuse. CPS has the power to request a Court order demanding the tests. They can also...

Is it possible to transfer probation from Houston, TX(Harris County) to Michigan

Asked by a user in Houston, TX - about 1 year ago.

The Interstate compact for Probation Supervison facilitates the transfer of adult offenders placed on probation whose supervision needs to be transferred to a state other than the state of conviction. Their website can be found at: http://www.tdcj.state.tx.us/parole/parole-instatecom.htm. Offenders must meet the following criteria to be eligible for mandatory transfer: (a) has more than 90 days or an indefinite period of supervision remaining at the time the sending state transmits the...

My son was on probation for organized criminal activity, they revolved his probation, but will reinstate it with stipulations

Asked by a user in Tyler, TX - 4 months ago.

The prosecution is simply offering him a plea bargain which he is free to decline and accept whatever punishment the court would impose. Having said that, I am sure that one of the first questions that he will be asked at trial, will be the nature of the deal. Defense counsel will try to make it look like he was bribed and therefore would say anything to avoid going to jail.

How do I have my ex husbands parental rights terminated?

Asked by a user in Lubbock, TX - 4 months ago.

It is HIGHLY UNLIKELY that a court would even consider terminating his parental rights. Having said that, if you feel that his conduct constitutes a danger to the children and that it would be in the best interests of the children for the custody order to be modified, you should consult an attorney. With respect to a modification of custody, it is also unlikely that the incident that you have depicted would be enough to get a judge to modify the current order. My suggestion is that...

Can I lose custody if I'm dating a previously registered sex offender?

Asked by a user in Merkel, TX - 4 months ago.

It is a possibility, but only if CPS or your ex files a SAPCR (Suit Affecting the Parent Child Relationship) against you. If CPS gets a call regarding the abuse or neglect of your kids, and after an investigation finds that there is reason to believe that your boyfriend poses a danger to the safety of your children and if they believe that you are failing to protect them, they could file a SAPCR. Additionally, if your ex learns that your child is around this person. He could also file a...

My son is almost 16,is being abused by his father and begs me to come live with me,what form do i file ?

Asked by a user in Forney, TX - 4 months ago.

If you decide to proceed privately, a petition to modify the custody agreement will need to be filed. In order to prevail, you will need to show what has changed to prompt you to request the modification and that the modification would be in the best interest of your son. If you choose this option, I strongly suggest that you retain the services of an experienced family law attorney. Although I would not recommend it, you could call the Texas Dept. of Family and Protective Services if you...

In Texas, can CPS order that my current wife (no relation to child) submit to drug testing?

Asked by a user in Longview, TX - 4 months ago.

Is the case currently in court? I ask this because only a Judge can issue an order. If you are dealing solely with CPS, either through family based services or during an investigatory stage, CPS cannot "order" anyone to do anything. Any actions that are taken are considered "voluntary" (I put the word voluntary in quotes as the CPS request often feels as if it is made at gun-point). If you are dealing with CPS, I strongly advise that you retain the services of a lawyer who is...

Is that true that CPS puts children on psychiatric drugs?

Asked by a user in San Antonio, TX - 3 months ago.

CPS is a government agency. They are not doctors and cannot prescribe meds. However, they usually send kids into therapy to deal with separation and other issues. If the therapist recommends that the child be seen by a psychiatrist or other MD and that Dr believes that meds are needed they will be prescribed. Needless to say, most children who are in foster care aren't exactly thrilled. They miss their families and may act out. Mix in the psychological effects of abuse or neglect and...

Asked by a user in Spring, TX - 4 months ago.

There is no right or wrong way to name a child. It is a personal decision that a lawyer really can't help with.

As the non custodial parent, what are my legal rights when my child has been removed from the home by CPS in Texas?

Asked by a user in Mabank, TX - 4 months ago.

If you want to be involved with your child's life, you should immediately find out the caseworker's name and contact information. Once you have the information, CONTACT THE CASEWORKER!!! You should also find out if/when/where the next court date is. Based upon your statement, I am not sure if your daughter was placed with the grandmother as part of a safety plan or pursuant to a Court order. If the Courts are involved, if you are interested in continuing a relationship with your...
