James Henderson still practicing law?

Asked by a user in Sherman, TX - over 2 years ago.

You may check whether a Texas lawyer is still licensed to practice by looking at http://www.texasbar.com/. Look on the left side for a little box. It will ask you for the bar number, but that is not required--only the name.

How soon can one manufacture a product after submitting patent application.

Asked by a user in Naperville, IL - over 2 years ago.

Yes, as it is factually true. Of course, be sure not to say or imply that a patent has issued until it actually has.

I want to know if my girlfriend's lawyer is doing a good job on her accident case?

Asked by a user in Gaithersburg, MD - over 2 years ago.

First, please recognize that the lawyer represents your girlfriend, not you. So, any inquiries that get made will need to be by her or with her permission. If she has doubts, a second opinion would be appropriate. Beware, however, that another plaintiff's attorney may have some incentive to say that things are all bad (because then he/she may be able to pick up the case). I would recommend that you get a business litigation or general practice attorney. You will likely need to pay an...

JUST FIRED MY ATTY.

Asked by a user in Derry, NH - about 4 years ago.

Please don't yell. I would recommend one of your first stops be the New Hampshire Bar Association. Their website is at http://www.nhbar.org/ and they do feature a referral service. I would not recommend that be your only stop. Also ask friends you know in the community and business associates for their referrals to a good attorney, even if that attorney is not in the practice area you need. Likely that attorney knows other local attorneys who may be able to help you and who may give you...

Music copyright

Asked by a user in Washington - over 4 years ago.

The website Mr. Campbell references at http://www.copyright.gov is also an excellent source of information on US copyright laws--one of the most correct and concise I have encountered. See the circulars at http://www.copyright.gov/circs/ for a topical discussion that will likely well-suit your needs. As to your sampling question, see FL 102 on that site for a discussion of "fair use." You will find no clear answer to your question, as ultimately it is a matter of opinion based on a number...

Including celebrity photos in a publication

Asked by a user in Cincinnati, OH - about 4 years ago.

I don't disagree with Mr. Rose's answer, but I think you also need to look beyond defamation law. California and some other states have laws prohibiting the use of images of celebrities without their permission. These "antipaparatzi" laws are not based on defamation, but rather on the privacy rights of those photographed. The laws of the different states have different provisions for when this is applicable and what exceptions there are. Also note that if the "public newsletter" is an...
