I am on probation for state jail theft. I was just arrested for class b theft. Will I be revoked? Should I notify immediately?

Asked by a user in Dallas, TX - about 1 month ago.

In most jurisdictions, the probation officer will easily be able to find out when you pick up a new offense. I would not bank on them not figuring it out. With that said, some courts will amend your conditions when you pick up a misdemeanor rather than completely revoke your felony probation. Every court is different. I do not practice in Dallas, so you should probably contact a Dallas attorney who is familiar with your felony court.

Can I sue the retailer or manufacturer for a defective product

Asked by a user in Houston, TX - almost 3 years ago.

You need a lawyer if you plan on suing the sams for emotional distress, etc. If you just want to file a complaint with their company, no attorney is necessary. I personally feel this is very uncalled for. I can only imagine their response when you explain what happened. Shahin Zamir

Can I request a continuance on court dates to acquire more funds so that I may pay a private attorney (Texas)? DWI

Asked by a user in Dallas, TX - almost 3 years ago.

Depending on the court, you can call in and reset your case. Most won't allow this. Your safest bet is to find someone in Dallas that will work with you on a payment plan. If the court allows it, he/she can waive your presence during pre-trial settings. If you do not show up for your hearings as scheduled and don't have an attorney, the court will issue a warrant for your arrest. My 19 year old son is currently on probation for a DWI received 4 months ago this weekend he received a MIP what will happen now

Asked by a user in Corpus Christi, TX - almost 3 years ago.

I'm sure one of the conditions of his probation is that he not drink or be around alcohol. It could be a technical violation of his probation. That being said, I'm not sure that a Class C ticket for MIP will register on his probation officer's radar.

Can you be expedited from Texas to California?

Asked by a user in Dallas, TX - almost 3 years ago.

If you are held in Texas under a California warrant and you waive extradition, they have a certain amount of days to come pick you up. If the case is important enough to them, they will pick you up.

I have a girlfrined who is 16 and just had my baby. I am 23, what can I do to live with her. their parents know about it.

Asked by a user in Rosenberg, TX - almost 3 years ago.

It doesn't matter that the parents know about it or condoned it in the past. What matters is her age and your age. The fact that she had your baby is pretty much proof positive that you had sex with her, unless you can show that artificial insemination was used. You need to hire a criminal defense attorney immediately. I've seen many cases where the hospital where the child was born called the police, regardless of how the parents felt.

I am on deffered adjudication...can i file a motion for a travel permit outside the usa or do i need a lawyer

Asked by a user in Austin, TX - almost 3 years ago.

Typically, you speak with your probation officer, and they can make the arrangements for you to travel outside the country. Sometimes, they will ask for a hearing with the judge for the judge to make the call. If a hearing is requested, it never hurts to have a criminal attorney present to eloquently explain to the judge why they should allow the travel.

My minor daughter was offered an alcoholic drink in a chain restaurant.

Asked by a user in Houston, TX - almost 3 years ago.

Since there was no accident or arrest for DWI, I'm not sure that there are any civil remedies against the restaurant. However, furnishing alcohol to a minor is a criminal offense. You can file a report with TABC (Texas Alcoholic Beverage Commission) or your local law enforcement agency.

I've been told Euless PD has felony or criminal charges against me. Now my employer has threatened to fire me.

Asked by a user in Euless, TX - almost 3 years ago.

You can call any bond company to see if there are any outstanding warrants. It is never a good idea to blindly go and speak with the police, especially when you don't understand what charges they are looking at. Make sure you have an attorney with you if you do want to answer any questions.

Can you get a licensure with a Attempted Forgery Felony that was deferred adjudicated from 2004?

Asked by a user in Dallas, TX - about 1 month ago.

If you were place on deferred adjudication for a felony offense, you have to wait 5 years from the date you were terminated from your probation to be eligible for a non disclosure. I tell all my clients that if they are eligible for an expunction or non-disclosure, to definitely have it done. Many background companies can find these and it is completely up to an employer how they look at it.
