  • Very first DWI defense

    I tried the very first DWI case I ever had and was able to get a hung jury. The case was tried a second time because the prosecutor would not let it go. The second jury returned a not guilty. Since this time we have tried a number of cases from misdemeanors like DWI to Felony aggravated assault with a deadly weapon. Many cases do settle prior to trial, but we find that our willingness to take a case to trial returns an offer far superior to those received by our peers that are either too afraid to try a case or unwilling to "tee it up" and let a jury decide.

    Client was charged with possession of Xanax and was also caught with a quarter bag of Marijuana. I was able to show the prosecutor that their case was weak at best and the prosecutor dismissed all charges.

    Client was caught with multiple kilos of cocaine. I was able to get the prosecutor to see substantial problems with their case and the matter was reduced to a lesser and sentence was recommended at the minimum level. Client was facing a minimum of 15 years at the level originally charged.

    Description:
    Client was charged with Triple Homicide; Felony Murder due to the deaths of three children. Client recieved deferred adjudication probation on day of trial. The co-defendant in the case went to trial on first of three indictments and was found guilty. The co-defendant then plead guilty to the other two counts. She received a total of 15 years in prison. We maintained our clients position deserved unusual consideration due to mitigating circumstances and were able to minimize our clients role in the eyes of the prosecution and showed the DA's office that we would try the case if necessary. The DA then recommended deferred probation for our client on day of trial.
  • Possession of a Controlled Substance

    Description:
    Client charged with possession of Xanax. The arrest came from an out of county officer working local security in Houston. I was able to show the DA that the arrest was tenuous at best. She agreed and offered a Class C misd. The client felt that this was a fantastic result and took the offer.

    I was contacted by a potential witness to a federal gun crime. Grant Scheiner represented the target of the investigation. After discussing the case with my client to determine his exposure I was confident that I could not only help my client but also the main target. I contacted the ATF agent that was harassing my client and shut down the investigation. I then contacted Grant Sheiner and let him know what the agents were trying to do. Together we were able to protect our clients from the over zealous government agents.

    Client was facing 60 counts with some serious time. We were able to quickly negotiate with the prosecutor who agreed to file only one count. When time came for sentencing we were able to put on a presentation that cast our client in the most favorable light possible and the Federal judge sentenced our client to only 30 days.

    Client was the yardman who suffered the wrath of a dimented 5 yr old girls delusions. She accused him of some very heinous acts but could not ultimately back them up. The offers kept coming down as we got closer and closer to trial but the client stood firm in his innocence. We the trial date finally came around the prosecutor relented and dismissed the charges. Good things come to those who are not afraid of trial.

    Client was charged with possession of child pornography. The offers were good but when the client professed his innocence we set the case for trial and the charges were eventually dropped.
  • Felony Assault of a Family Member

    Client admitted to beating his wife and threatening to cut her wrists with a piece of glass. He had a previous conviction for beating his wife and another conviction for beating his mistress. The state refused to offer anything but substantial time in TDCJ. I went to the judge and showed her some weaknesses with the State's case and the need to get help for my client at which time she agreed to sentence him to deferred probation. The client was very happy.
