The other attorneys have provided good substantive background in their answers, but I would also point out that sometimes attorneys make mistake and use forms from one case to another. While I don't know the specifics of your situation, it may be possible that the attorney simply used a form and the question was asked inadvertently. I regularly receive form discovery requests from other attorneys, and sometimes questions are asked that have nothing to do with the case. I usually pick up the phone and call the attorney to verify if he/she actually intended to ask the specific question. Sometimes the answer is yes (for reasons of their own), but sometimes the answer is no. Just a thought!

As Bob pointed out, serious accusations can cause serious consequences if proven to be false. While I recognize that you are upset about what happened to you and want to help protect others, I would reconsider rash actions in the heat of the moment. Once you have given yourself some time to let go of some steam, you can follow the methods Bob set out. All are viable courses of action to take. I wish you well!

If you believe the damage and potential repair are serious flaws in the vehicle and cause the vehicle to be in something of less value than what you bargained for, then you should probably NOT take delivery of the truck and simply hash it out with the dealer. Taking delivery after a known problem might be considered a waiver, so I would advise against it. I do not know the details of the Texas Lemon Law, but Professor Richard Alderman at the University of Houston Law Center is known as "The People's Lawyer" and has a book entitled "Know Your Rights," which can be found at most major bookstores like Borders and Barnes & Noble. You should look at that book to see if it will answer your question. Also, the University of Houston Law Center has a Consumer Complaint Center that is run by attorneys with the help of law students. You can try contacting them and see if you can get a specific answer. Try www.law.uh.edu to get to the school's website, and then find the consumer center from there. Good luck!
