    You absolutely need to contact a lawyer asap. The insurance company will lead you on for months and then merely insult you with a low ball offer down the road at best.     I'm sorry for you loss. As others have stated, it is not in your best interest to talk with the driver's insurance carrier. They are not there to help you. There job is to figure out how to avoid compensating you and your family or to minimize the compensation. You and your family needs a lawyer and you need one that is experienced in handling trucking cases, and it is important to hire a lawyer sooner rather than later so that important evidence can be collected and preserved. Picking a lawyer for a case like this is a very important decision and you need to be comfortable with who you hire. Talk to several lawyers and see who best fits your needs and comfort level.     You definitely need to consult a lawyer before you do anything. Once you sign a release, that is the end. You need a good lawyer that handles these types of wrongful death cases to ensure that the insurance company is paying everything available under the insurance policy. Plus, there may be other potential avenues of recovery that may be forever barred or at least hampered by an early settlement with the driver.     Depending on the facts, yes. Additionally, in Texas, most property held in the marriage is considered "community property;" hence, you can collect from those community assets to the extent the drunk and his spouse have any substantial assets to satisfy a judgment.
