Sounds like you have a case, but you definitely will want to retain a lawyer to assist you in making and supporting your claim. I actually had a very similar case involving Walmart that we resolved earlier this year where they assembled the front wheel assembly backwards and failed to properly tighten the wheel which resulted in the wheel coming off and the client face planting into the sidewalk. Walmart will want to "inspect" the bike, so it is very important that you retain the bike and do not try to fix it or ride it. Put it in a safe place and lock it up to preserve it as evidence. I would also recommend that you retain a good experienced attorney immediately as Walmart will also want to interview you, and of course anything you say they will try to find a way to use against you. Hope this helps and best of luck. Feel free to holler if you'd like to discuss further.

  • 18 wheeler accident. ...Do I need a lawyer or can I handle the case since liability is not a issue? ??

I was t-boned by a big rig who ran a red light. My light was green, as I proceeded through the intersection, he hit the passenger side of my car. My car slid and then flipped over on the driver side and slid some more. He came to a stop after hitt...

You absolutely need to contact a lawyer asap. The insurance company will lead you on for months and then merely insult you with a low ball offer down the road at best. By the then, much of the evidence that a lawyer would want to have collected for you may be gone. Please feel free to give me a call, but whatever you do, get in contact with a good lawyer asap.

  • Wrongful death???

My father died as a result of being rear ended by an 18 wheeler. There was a highway patrolman that witnessed the entired accident and appears, by all accounts, to be the truck driver's fault. I know we live in a nation of litigation, but what kin...

    Jason’s Answer

I'm sorry for you loss. As others have stated, it is not in your best interest to talk with the driver's insurance carrier. They are not there to help you. There job is to figure out how to avoid compensating you and your family or to minimize the compensation. You and your family needs a lawyer and you need one that is experienced in handling trucking cases, and it is important to hire a lawyer sooner rather than later so that important evidence can be collected and preserved. Picking a lawyer for a case like this is a very important decision and you need to be comfortable with who you hire. Talk to several lawyers and see who best fits your needs and comfort level. There are many good lawyers on this site and in your area. My firm has handled many of these cases, we are near you, and I would be happy to personally speak and meet with you. Please feel free to call me at (817)920-9000 or toll free at (877)920-9009. Sincerely, Jason Stephens

You definitely need to consult a lawyer before you do anything. Once you sign a release, that is the end. You need a good lawyer that handles these types of wrongful death cases to ensure that the insurance company is paying everything available under the insurance policy. Plus, there may be other potential avenues of recovery that may be forever barred or at least hampered by an early settlement with the driver. We handle these types of cases throughout Texas, so feel free to call (817)920-9000.

If Driver A is at fault and Driver B accepts the insurance settlement, can Driver B's passengers still sue?

    Jason’s Answer

Absolutely, so long as Driver B isn't the parent or guardian of his passengers and doesn't sign a broad settlement releasing the claims of his kids or guardians. Feel free to call if you'd like to discuss further. Jason Stephens (817)920-9000.

  • Durnk causes accident, can spouse be held accountable for death/damages in the state of texas

if spouse gets intoxicated and causes accident, can spouse be held responsible for damages

    Jason’s Answer

Depending on the facts, yes. Additionally, in Texas, most property held in the marriage is considered "community property;" hence, you can collect from those community assets to the extent the drunk and his spouse have any substantial assets to satisfy a judgment.
