What can I do if I had my license suspended due to an accident where I had a black out an ended up in an accident?

Asked by a user in Houston, TX - about 2 years ago.

Was your license suspended because of a judgment or a medical condition that led to the blackout? If the license was suspended due to an unsatisfied judgment, you will need to make payments to satisfy the judgment. The DMV will typically lift the suspension as long as you are making routine payments to satisfy the judgment. If your license was suspended due to a medical condition, you need to speak with the DMV to see under what conditions your license was suspended. It my be a matter of...

We are being suied for a large amount and we can not pay what the insurance dose not cover can they take the house we live in?

Asked by a user in Cypress, TX - about 2 years ago.

Not if you have applied for a homestead exemption. You should have an attorney provided under the policy. You should discuss your fears with your attorney and your insurer. If an offer is made by the injured party to settle for the policy limits and your insurer refuses, the insurer may be responsible for the entire judgment.

Who is at fault? The police officer would not file a report?

Asked by a user in Fort Worth, TX - about 2 years ago.

The driver that was behind you would be responsible for damages to both your vehicle and to the vehicle that you were forced into. The driver behind you failed to leave sufficient room to timely stop and is responsible for all injuries resulting from such failure, including damages caused by the second collision. Feel free to contact me at 817/877-3355 should you have any questions.

Can I be sued for defamation or libel even though no names were mentioned?

Asked by a user in Yorktown, TX - almost 3 years ago.

As Laura mentioned, you can be sued for just about anything by anyone. Being successful, however, is a different story. To be successful in a defamation claim, you must show that the defamatory comment in question was unambiguous about both its meaning and the individual who was the target of the comment. In addition, truth is always a defense to a defamation claim. If it is unclear from your post as to who you are talking about, if your post was entirely your opinion and not stated as...

Is it illegal to get information from a liable party insurance company for personal injury

Asked by a user in Houston, TX - about 2 years ago.

It would depend on the information was obtained. Simply knowing the policy limits is not illegal as it would be discoverable upon filing a lawsuit; however, if the information was obtained through an illegal means such as breaking and entering or tapping into someone's computer then there would be concerns. If the information was simply provided upon request - then there is no problem.

Online Search Records still exist even after expungement

Asked by a user in Garland, TX - over 2 years ago.

You may need to contact the website that is posting the information and tell them to cease and desist pursuant to the order. It is illegal to disseminate information subject to an expunction disorder if the party posting the information has notice of the expunction order. It may be helpful to retain an attorney to draft a letter for you. Feel free to visit my website for additional information.

Can I a file a civil suit against the young men & family whom were involved in the murder of my beloved son?

Asked by a user in La Marque, TX - about 2 years ago.

I am also sorry to hear about your loss. It would appear that you may have a problem with the statute of limitations, which would be two years. While there are limited work arounds in a wrongful death case, it appears based on your limited facts that your case may be barred. As the first poster points out, there may be little compensation involved if you were to go forward. Wrongful death claims are emotionally draining, and sometimes therapeutic. Typically there is not much of a reason...

My friend wrecked his motorcycle with me on back. We hit the curb of his driveway leaving his house and fell over.

Asked by a user in Houston, TX - over 2 years ago.

You have a lot of issues going on and it would be best to sit down with a personal injury attorney in Houston who can explain your options. Home owners policies will typically not pay on personal injury claims; however, certain types of claims may bring a home owners policy into play. You may also be able to recover from an umbrella policy. It is too early to make any estimate on your damages considering you have not yet recovered from your injuries and therefore do not have any idea on what...

Do I have the right to know a person's insurance policy info if in personal injury lawsuit with that person?

Asked by a user in Dallas, TX - over 2 years ago.

If you have filed a lawsuit, then the Defendant will have to disclose the policy limits in discovery; as mentioned, you should have a lawyer involved if you are in an active lawsuit and limit any communications with the opposing side. If you have not filed a lawsuit, the insurer does not have to disclose the policy limits and typically will not.

What will likely happen to me?

Asked by a user in Dallas, TX - over 1 year ago.

I am not sure why the first attorney is suggesting that you pursue a personal injury claim as you did not mention anything about being injured. I agree with Mr. Lundeen as it would not be appropriate to discuss this matter in depth as you have retained an attorney and all questions should be addressed to him/her. Your lawyer is in the best position to advise you of your options considering all available facts. That being said - I would be surprised based on what you said if you were...
