  • Aunt & Uncle taking 15 yr old to live with them until mom can move; what is needed for school and medical needs?

    We are moving and want to take my 15 yr old nephew to get him settled; his mom will be moving first of the year. What do I need to enroll him in school and seek medical attention if needed?x

    With Chapter 34 of the Texas Family Code it does not appear a guardianship is necessary in your situation. Chapter 34 allows a parent or both parents of a child to enter into an authorization agreement with a relative of the child. This Agreements authorizes the relative to make decisions regarding medical, dental psychological, or surgical treament and immunization of the child and to obtain and maintain health insurance coverage for the child. Chapter 34 gives a complete listing of the specific acts this Agreement allows.

    Under the Texas Probate Code, you must file in the county where the minor child resides or is located on the date the application is filed or in the county where the principal estate of the minor is located. It may also be filed in the county where the minor's parents live. There may be other alternatives, for example Texas Family Code Chapter 34 Authorization Agreement For Nonparent Relative. With this authorization, a parent or both parents of a child may enter into an authorization agreement with a relative of the child to have the authority to make decisions on behalf of the child, such as medical, dental, psychological or surgical decisions, obtain health insurance coverage, enroll the child in school or daycare, etc. This list is set out in Chapter 34 of the Texas Family Code.
