If you refused a breath test and your blood was obtained by a warrant, you have 2 more days to request a hearing on the potential suspension of your driver license. If you did not refuse breath but consented to blood, you will only be notified of a potential suspension if the results of the blood test are .08 or higher. They will mail you notice of the potential suspension to the address on your driver license, so you need to make sure your address is correct. If your results are below a .08,...

Non US Citizens always face potential deportation when convicted of a crime. Most will face deportation if they are subject to a year in jail if convicted of a crime. A second DWI has a range of punishment of up to 1 year in jail, but the amount of jail time any individual could potentially face could be capped at less then a year with an agreement with the prosecutors. However, any conviction could result in your friends deportation. My suggestion is that you meet with a highly qualified...

It is common for cases not to be filed by the original court date. The police department could be waiting for the blood results before filing the case with the DA's office, or the case could be at the DA's office and in the process of being formally filed. So do not read into anything about the case not being filed by the initial court setting. From time to time cases may never get filed, and part of that reason could be that the blood results were too far below a 0.08, indicating the...

If you cannot afford a lawyer, the court will appoint you a lawyer. Some are very good, others are not. If you are not a citizen, the court will inform you that any plea to the charge could result in you being deported. If you are subject to a year in jail on a plea, that will increase your chances of being deported. Immigration pays closer attention to cases where non-citizens are subject to 365 days or more in jail. It is my advice to hire the best lawyer you can afford. Your future...

The law in the State of Texas does not allow for an expunction of DWI where you were either convicted and served jail time or convicted and placed on probation. You would only be permitted to expunge a DWI if you were found Not Guilty or if the case was dismissed, and then you would have to wait the 2 year statute of limitations before being eligible for the expunction. Other states have different laws (rules) concerning this, so many people inquire because friends from other states were...

If you are looking to help your friend, you need to contact a DWI where his case is pending to start working for him to try and minimize the potential consequences. For their sake, I hope his case is not in Denton. But a case that old can definitely be worked with. Mistakes are mistakes, but 13 years of productivity should not be ignored. A lot must be done quickly and assistance will be needed since his new life is so far away. I am here if you need more information. Doug

They can, but it could be very difficult to prove. The amount of the drug(s) found in your system will be very crucial to your defense, and whether or not the prosecution can prove that the amount of drug in your system caused you to lose the normal use of your faculties. Everyone is deemed to be intoxicated at a 0.08 or more blood alcohol concentration, even if you have a high tolerance to alcohol. There are no "per se" limits when it comes to drugs in the system. If you would like to...

When a Judge or Magistrate order an Ignition Interlock (breathalyzer) to be installed in someone's car, they are also ordered not to drive any other vehicle that does not have one in the car. There is an exception to this, but that exception only applies to work vehicles. I know some people will do just what your friend did. Buy a junker and install it in that. The consequences of that could be very severe, depending on the county. If the interlock is a condition of their bond and they get...

Up front, the DA is not going to just dismiss your case because of your immigration status. The resolution of your case is going to depend on the facts, and the quality of lawyer that you hire to assist you. A thorough investigation must be made, making sure there are no legal loopholes (so to speak) that can be discovered that could help in getting the case dismissed. As others have said, you need to contact several lawyers and meet with them. You need to evaluate the lawyers to see who...

Judge's can set conditions of your probation. The reason you are in trouble is because of alcohol. So it is very common today for almost all courts in North Texas to restrict any alcohol consumption during a probationary period. In Denton County, there is a no alcohol condition of every probation, regardless of the crime. I have seen Judge's, for Felony DWI probation's, order the person to remove all alcohol from their house, in what ever form (mouthwash, vanilla extract, etc). I agree...
