In Texas, the court signing the Order maintains jurisdiction over that order for only 30 days (with some exceptions). Therefore, it is very important that you contact an attorney and have something done within that time period, before your opportunity is lost to file any motions that may get your case back onto the courts docket. The Small Claims courts are governed by the same rules as the District Courts as far as procedures go, other than what the Small Claims court wants to change or alter. I suggest you contact a general practicioner attorney in your area for information and advice on how to proceed. If you want to do it on your own, the Justice of the Peace or Small Claims court has a maximum jurisdiction of $10,000.00 that you can sue for and is very inexpensive to file the lawsuit yourself. The JP Courts are under the same rules as other courts, the Texas Rules of Civil Procedure. Prepare your Request for Production and serve it on the other side, either by CMRRR, fax, or personal delivery. If they object to having to answer them, the burden is on them to object. Good luck.
Since you have an attorney handling the case, you will need to speak directly to him/her.
