I filed for divorce without an atty and got remarried, but now I'm being told the first marriage never ended. What do I do?

Asked by a user in Dallas, TX - about 3 years ago.

I believe that your second marriage is void, as you were not divorced from your first spouse. Under the law in Texas you cannot be married to two people at the same time, bigamy is against the law. What you need to do is get your divorce finalized and then get remarried to your current spouse. If the your original divorce was dismissed you will need to begin the whole process again; filing, getting the original spoused served, dividing property, if there are children, child support and...

In the state of Texas, is a no contest plea with deferred adjudication considered a conviction?

Asked by a user in Dallas, TX - about 3 years ago.

The charge, I'm sure was dismissed. Although it was dismissed, it will still appear on your record as "dismissed through deferred". You can do a Motion for Non-Disclosure which won't make the charge totally disappear, but will, for lack of a better word, seal your record from most prying eyes.

Can lawyers do anything about speeding tickets that have turned into warrants? or should I just pay the fines?

Asked by a user in Fort Worth, TX - about 3 years ago.

You are correct, ADD is no excuse. If you go ahead and simply pay the tickets they will appear on her record and very well could affect her automobile insurance. More than likely the court will no let you go to court for her and dispose of her warrants and cases. You could hire an attorney to represent her in court. Depending on the court she would not have to appear.

Traffic tickets turned into warrants, what are my options?

Asked by a user in Mckinney, TX - over 3 years ago.

This depends on what status the warrants are in. If they are in capias status, the only option is to pay them. If they are in alias status, you can either post a cash bond with the city of McKinney or hire an attorney to post attorneys bonds. Please note that this will not dispose of your tickets, it will simply put them back on the docket and allow you to appear in court on them.
