Can my wife get custody by filing a protective order?

Without having seen the papers with which you were served, any answer to your question would be a guess, at best. However, not showing up for court is a sure-fire way for your wife to get whatever she wants. Unless the person who tells you what a judge can or cannot do is an attorney, you can just go ahead and ignore 100% of what that person tells you about your case. If getting custody of your son is a big deal to you, see an attorney about it.

How do i get custody when the other parent is suicidal?

If he has threatened suicide, I would certainly advocate being on the safe side rather than sorry. A restraining order may be granted to restrict his access to the child (ren), and it will be effective until the court conducts a hearing for temporary custody. This will usually occur within two weeks of obtaining the restraining order. The temporary custody hearing will result in a custody order that will be effective until further order of the court or your final orders are in place.
