    .35 Breath Test - Charges Thrown Out by Judge
    Description:
    Client had numerous prior DUI convictions. Came to me after former attorney advised him there was nothing that could be done to keep him from going to prison for 10 years. Went to court hearing on the .35 breath test. Police Officer could not show he followed the appropriate procedures and therefore the the State could not show the breath test numbers were reliable. Officer also made illegal arrest. Case dismissed by the Court. No fines, no costs, no community service, and most importantly no prison or jail time for client.

    High profile Client illegally stopped by police for suspicion of drunk driving. Officer admitted to conducting the field sobriety test improperly. Officer also admitted that holding improperly conducted tests against my client was not fair. Court found stop to be illegal and case dismissed.

    Registered nurse followed from bar by officer and stopped for swerving and crossing center line. After nearly 3 months of fighting to get police car dash camera video we were finally able to obtain the tape. After review we discovered that there was no swerving, no crossing the center line, NO bad driving at all. Case was dismissed and expunged from the persons record. After appealing the Department of Public Safety the drivers license was also given back with no restrictions.

    Successfully argued complicated issues over who are authorized individuals to draw blood in the state of Oklahoma. Eventually won the argument that the State did not follow the law when enacting rules for the Department of Public Safety. Therefore the blood was illegally drawn and was thrown out.

    Held administrative hearing on a driver license revocation and was ruled against by the Dept of Public Safety. I felt they were out of line in their decision so we appealed to district court. After hours of testimony and argument we won and the DPS ruling was set aside. The court found the officers testimony to not be credible. That by itself is a huge feat.
