There is an easy way to take care of the pre-trial no-contact provision of your release. You can enter a no violence order which allows contact, just no violence. It helps if the alleged victim will sign on to the idea.

  • My question is to you what can I do next

my family is being stalked and haraass everyday and yes I call the police four time. And they said at I need proof .

    Shane’s Answer

You need to document all of your run-ins with the person who is harassing you, as well as all of your calls, etc. to the police. At some point, perhaps they will take action if necessary. You also may want to consult a local attorney that can address the problem directly with the courts.

    Shane’s Answer

Suppression of search warrants is a very complicated area of the law. A clerical error in of itself does not invalidate a warrant. However, certain things do. If the wrong residece was actually searched, that is certainly something you need to get an attorney to look into. The totality of the circumstances involved could lead to the warrant being suppressed. You need to get an attorney to look at it very closely.

Your friend needs to be clear as to why the lawyer did or did not appeal certain issues. The lawyer very well may have valid reasons for all of his or her actions. The appeal may concentrate on a few strong appealable issues rather than simply taking the "kitchen sink" approach.
