You cannot get probation on a residential burglary unless its TASC. There is always a chance of getting the charges reduced for probation. It may also be a good case for trial. Has he had his preliminary hearing yet?

Sounds like it's over, I wouldn't be worried.
It carries 4-15 years in prison. Hire an attorney for the best result. I would try to get him boot camp which would get him out in 4 months.

You need an attorney. I'm sure the police report will say something different.
