    Peter’s Answer

You could take them to court but the cost may exceed the value of the vacation. Contact the IDOL and also try one more time with the FSO. Tell him/her that you will contact the IDOL if you don't get any relief and save any emails you have regarding the issue.

Generally speaking no. However, more information would be required before your specific case could be determined. I would suggest speaking with an employment lawyer and going over all of the details.

I signed a non-compete that forbids me to work for a competitor or start my own staffing business for 24 months beyond termination. I also found out that there was a clause that automatically would award the company 20k for each discovered offense...

    Peter’s Answer

You really need the attorney to review the non-compete in order to have your answer addressed fully. It is very hard with the limited information you provided. You have to also balance what you received to sign the non-compete.

  • Any type of legal action I could pursue?

Was trying to be forced to come back earlier from my maternity leave. When I said I couldn't, they said they would cut my days and hours and would lose my insurance. Had to leave my job b/c I couldn't work under those conditions

    Peter’s Answer

Are you sure the company only has 9 employees as 15 is the cut off for pregnancy discrimination. If the company has two locations, both locations can be added together. How long did you work there, were there any medical issues? Much more information is required.

I agree with the other two answers. When you were hired, were terms discussed and do you have a copy of that email or document? That would be the most help in a case like this. Also, consult with an employment attorney.

It would come down to what the entire contract says and what proof the company actually has of your alleged misconduct. You should speak with an employment lawyer and bring a copy of the contract.
