Insurance Denied Claim

Asked by a user in Chicago, IL - about 4 years ago.

Would $850 compensate you fairly? If yes, settle your case. It costs money to file suit. You can get the filing costs back if you win. Also your recovery may be affected by the percentage of your own fault, if in fact you were partly at fault. If you feel they are not being fair, sue bastards.

How can I prove that former co-workers are sending faxes and emails with false acquisitions about me to every potential employer

Asked by a user in Chicago, IL - over 2 years ago.

Find a way to receive the same information from them. Then decide. It may be all in your imagination. Can a friend call on your behalf? Do you have a family member or a friend who owns a company who could find out on your behalf? Somehow, if you really believe this to be true, you have to come up with creative ways to have them replicate the false accusations. Of course you have to conduct yourself in a way not to break the law in the process.

My son was hit by a car. The driver was at fault and tried to leave the scene. Should I sue her?

Asked by a user in Chicago, IL - over 2 years ago.

Depending on the judge, her action after the impact may or may not be allowed at trial. She may also come up with many reasons why she didn't stop right away. If you just want to sue her for the "principle" of it, I say let it go. Instead, focus on your son's injuries. You may want to be sure that he doesn't have permanent injuries as a result of this accident. Sometimes, injuries don't show up right away. Don't settle your son's case too soon, unless you are sure he is not seriously or...

The maintence man at my complex crashed my car causing 6000 in damages, it was covered by my insurance. Can I sue for negligence?

Asked by a user in Warrenville, IL - over 2 years ago.

Wow! This sounds more like a joke than a real situation. Yet, I give you the benefit of the doubt, and answer this question in good faith. In short, the answer is yes. Under the Illinois law, the fact that your insurance company fixed your car is irrelevant to the wrongdoer, and the wrongdoer won't get credit for it. You can sue the wrongdoer, recover your damages, then negotiate with your insurance company to pay them back less than what they paid out. The difference will be yours to...

School Nurse Liability

Asked by a user in Chicago, IL - almost 4 years ago.

You are considered their agent. So unless you commit something egregious and grossly outside of the norm, you should be covered. Any ordinary negligence on your part should be covered by the school district's insurance. If your contract with them says you are an independent contractor, you may still be considered their "apparent agent". However, if they can legally win on the issue of apparent agency, you will be on your own. Under those set of facts, I highly recommend having your own...

Can I sue my ex-box for slander, deflamation of character and possibly anything else??

Asked by a user in Acworth, GA - over 2 years ago.

Under common law, four classes of words, if falsely communicated, give rise to cause of action for defamation without showing of special damages: words imputing a criminal offense, words imputing infection with a loathsome disease, words imputing inability to perform or lack of integrity in performing duty of one's profession, and words prejudicing party in his profession. So, yes, you can sue him. The Illinois slander and libel statute is 740 ILCS 145.

Can I sue a cashier for personal injury to my daughter from a dropped box?

Asked by a user in Moundsville, WV - over 2 years ago.

Yes. Not just the cashier, but anyone else should exercise ordinary care for the safety of others. This cashier is no exception. Also, if the employer and the owner of the store is liable under the law. Lastly, because of the age of the child, they can't hold him/her responsible for being negligent.

Can a auto mechanic drive my car and add excessive miles while waiting on me to pay my bill? What are my rights as a customer?

Asked by a user in Indianapolis, IN - over 2 years ago.

This sounds suspicious. What proof do you have that the mechanic actually added the mileage? If no proof, then it will be difficult to win against him. If you have the proof, you are due an explanation for the use of the car. No, a mechanic can't and shouldn't just drive a customer's car to the tune of 300 miles.

If a person was quesioning for burned car and a similar situation has happened again, what can happen.

Asked by a user in Arizona - over 2 years ago.

Nothing, as long as the truth is that the person didn't do anything wrong. If a person is accused of the same illegal act, authorities, or insurance companies, may become more suspicious. The odds of the same thing happening is very low. If, on the other hand, the person did it, then, he/she should be worried about the original accusations since the natural tendency is to assume the first one was his/her work too.

Auto damaged by snow sliding off restaurant’s roof; a month later damages still not covered. What’s my best course of actio

Asked by a user in Brick, NJ - over 3 years ago.

I don't know about the law where you are, but in Illinois, for property damage, you have 5 years to sue. It is not worth hiring a lawyer for $612. Yet, it is your right to recover your damages in full. I don't think that a month is such a long time to get upset over. Insurance companies are slow in general, not only because they want to hang on to your money for as long as they can, but also because they have to process a lot of claims. I wouldn't worry much about the delay, but you should...
