It depends on your job duties whether a person employed in the trucking industry is exempt from the overtime pay requirements of the Fair Labor Standards Act ("FLSA"). The Motor Carriers Act exempts not only drivers of vehicles that weigh more than 10,000 lbs. from the overtime pay requirements of the FLSA, but also driver's helpers, loaders, and often mechanics. The interplay between the FLSA and Motor Carriers Act is complex and you should seek advice from an attorney who knows the practice area. Good luck.
