    Practice Area:
    Aviation
    Date:
    Dec 07, 2009
    Outcome:
$7.1 million jury verdict for the plaintiff
    Description:
Following a four day jury trial which took place at the United States District Court for the Eastern District of Kentucky at Lexington, an eight member jury returned a verdict of $7.1 million in favor of the family of a 39 year old who was killed in the Comair airplane crash at Blue Grass Airport in Kentucky. In the early morning hours of August 27, 2006, a Comair/Delta Connection regional jet attempted to take off on the wrong runway, one that was too short. The airplane ran off the end of the runway into the grass, hit a berm and after leaving the ground momentarily crashed through an airport perimeter gate then into a row of trees then slamming the ground plowing into more trees before coming to a rest in flames. Forty-seven passengers and two of the three crew members on board were all killed in the airplane crash. The copilot survived with severe injuries. All other passenger death cases were settled without a trial.
  • Hanson v. Unnamed Trucking Company

    Practice Area:
    Trucking Accident
    Date:
    Jul 23, 2009
    Outcome:
$6.9 million settlement during deliberations, $4.8 million more than the defendant's best pre-trial offer to settle
    Description:
A $6.9 million settlement was reached between a major semi truck company and two individuals moments before a jury was about to deliver its verdict after a four day trial in Madison, Wisconsin. A family was torn apart by tragedy when a semi truck drove over a stopped car killing two of its occupants, a fifty-two-year-old woman and her four-year-old granddaughter. The third person in the car, a fifty-eight-year-old man, survived the crash with a fractured leg and post-traumatic stress disorder. While the trucking company admitted fault before trial it argued the damages should be valued at $2.1 million. During the four day jury trial the trucking company’s offer went up incrementally until the case finally settled for $6.9 million just before the jury was about to return what jurors interviewed after the settlement said would have been a $6.5 million dollar verdict.
