No , sadly, you do not qualify for deferred action. Two DUIs are potentially risky for most immigration applications for they could suspect you have an alcohol addiction. Any more DUIs and your chances of taking advantage of any immigration reform will also shrink significantly. I strongly advise you to never driving under the influence and not risk further problems. As other attorneys state, your father in law cannot be a joint sponsor as he is not a US citizen or permanent resident. The joint sponsor can be any USC or LPR who makes sufficient income and need not be related. Your wife must show US domicile by proving assets or other ties to the US. This is something an attorney can help you with if you desire. Dhenu Savla, Esq. SwagatUSA, LLC www.swagatusa.com

I agree. Intent issues are tricky. Do not take advice from a paralegal. Take a look at this blog post that I've written on intent issues: http://www.swagatusa.com/archives/1081 Dhenu Savla, Esq. SwagatUSA, LLC www.swagatusa.com/attorney

One note of caution. Make sure that your mom meets 125% of the poverty guidelines when counting the total members in the household PLUS one for an intending immigrant. First of all, did your husband enter with a visa? If not, he may not qualify for adjustment of status. You MUST talk to an attorney before you file these complex applications. If you mess up, resolving the problems can be very expensive and time consuming! Dhenu Savla, Esq. SwagatUSA, LLC www.swagatusa.com/attorney

It can be done if you can convince the USCIS that your marriage is not for immigration purposes. You would need to explain your age difference.

How recent are the DUI? These can be problematic. Yes, he can probably still get a green card through you, but I would caution him against drinking and driving ever again. A third DUI will certainly be taken very seriously and can block a green card. Dhenu Savla, Esq. SwagatUSA, LLC www.swagatusa.com/attorney
