Bankrupcy or ?

You need to determine if there was a judgment entered aganist him or there is just a claim pending. You also need to know if the claim is for property damage or personal injury or both. You need to look at the statute of limmations also. You should also look to make sure the claim was actually paid or if the $13,000.00 is an estimate of what they are looking for.

Is wk comp pay based upon date of initial injury even if I returned to work for over a year?

In Illinois you are entitled to 2/3 rds of your average weekly wage (AWW) when you are off work getting TTD benefits. If you are now off work for your original injury your AWW is based on the original injury date. If you are off work due to a second injury the AWW is based on the rate of pay on the new date of injury. It is calculated the same way as before and may increass or decress dpending on if you earned more monay or worked less hours.

I have been fired with an existing work comp claim still open, i need another knee surgery, who pays for it?

If you did not settle the original case, the comp carrier has to pay for the second surgery. Unfortunatly you do not get pain and suffering in a work comp case. You can not keep medical open unless you try your case. Your only remedy is the work comp act and you can not sue your employer directly. If there was a defect with the ladder and the ladder was provided to you by a third party you may be able to sue that party. You only are entitled to three basic benefits in an Illinois Workers...

The car that hit the first car. If you have collision insurance you should make a claim to your own insurance company, they should pay the claim, then collect aganist the tortfeasor.
