Practice Area: Juvenile
Outcome: Motion denied
Description: Randall was just a couple of days shy of turning 17 when he was charged in juvenile court with violating his probation. I unsuccessfully challenged Randall's automatic removal from the Juvenile Detention Center and confinement in the County Jail on his upcoming birthday. On appeal, the 2nd District reversed. However, the IL Supreme Court dismissed the appeal as having been briefed, argued, and ruled upon based on interpretation of an inapplicable statute. In a footnote, Justice Thomas writing for the majority noted that I tried to convince the trial court that its ruling was based on the wrong statute.
