Under MN dui laws can a person be charged for dui if the car is parked

Asked by a user in Faribault, MN - over 3 years ago.

I am a Minn prosecutor. Yes, you can be charged with DWI, even while sleeping in your own car. It does not matter if you are in your driveway or not, in Minn, you can get a DWI anywhere in the state. It also does not matter if you are intoxicated, we use the standard of "impaired" and have a per se limit of 0.08 AC. The factors that the officer and prosecutor will need to consider include if you were in fact in physical control of your vehicle. Where were the keys? Was the vehicle...

Wrong licence plate number recorded on ticket

Asked by a user in Palm Desert, CA - over 2 years ago.

I am a prosecutor in Minn, so CA might have slightly different laws and procedures, but in general, yes, it is most likely still valid. Clerical errors can be fixed at any time. Now, if you are able to show that the vehicle that actually has the license plate number that is on the ticket is the same make, model, year, color, etc of yours, you would then have an argument. If you could also show that it is in the same part of the state, on the day and time the ticket was issued, you just might...

How do insurance companies obtain your driving record? Why as citizens do we allow the government to cooperate in this manner?

Asked by a user in Lander, WY - over 2 years ago.

Each state has its own data privacy laws, so for specifics you will need to consult with an attorney in your state. In general, the State department that maintains a person's driving record does not automatically send a record of a conviction to an insurance carrier. The odds are that if you pay your premium on time, don't buy a new car, don't change carriers, etc, your Insurance company won't find out about your new speeding ticket. Now, if you call your agent and say, "I just got a DWI,...

Fighting a speeding ticket in Lake County, IL

Asked by a user in Lake Forest, IL - over 2 years ago.

You should be able to present it by going to Court and telling just that to the Judge. Now, whether it will do you any good is another question. I am a prosecutor in Minn, but if I were the Judge, I don't think it would make any difference. Why you missed the sign is not really important. What is important is that you were speeding. If you were going so fast that you weren't able to both watch the road and read road signs at the same time, then you should have slowed down. If you had...

Is it possible that an off duty state trooper can claim to have have seen someone driving w/out a license and later file charge

Asked by a user in Rensselaer, IN - over 2 years ago.

I am a prosecutor in Minn. I can try to answer half of your question. Yes, it may be possible for an officer to issue a ticket for a violation that he observed, even if they don't approach or arrest you on the spot. I can't answer the part about the arrest warrant as that will vary state to state. Here, it would have to have been a summons to court on the ticket.
