My ex is in contempt.

Asked by a user in La Crosse, WI - about 2 years ago.

You can take him back to court to get the disclosure enforced. However, if he owns his own successful company, this sounds like a tip of the iceberg issue. My radar is saying he is hiding assets and maybe you are due a lot more. Then you may need to get into revisions of the previous orders of support, etc. Chris

Can I get a sentence that got a diversion sentence expunged in Wisconsin?

Asked by a user in La Crosse, WI - about 1 month ago.

If you enter into a diversion agreement, you plead guilty, but the conviction is not entered. Technically, you are not convicted of any crime. If you complete the diversion successfully, the charges are then dismissed, so it shows up on your record as a dismissed case. Because there is never a conviction, there is nothing to expunge. Chris

Neighbor makes rude comments to me and my young children, also gives us the finger when driving by

Asked by a user in La Crosse, WI - almost 3 years ago.

Here in La Crosse, the first step you might consider taking is getting a restraining order or harassment injunction. You can certainly hire an attorney to do this, but you can also go down to court and do it yourself. I believe they have forms you can use. An injunction served on this person would order him to stop what he is doing and leave you alone, under pain of arrest if he didn't. You should remember that a harassment injunction is only worth the paper it is printed on -- it cannot...

How do I write an answer to a summons on a credit card-have no money for a lawyer?

Asked by a user in La Crosse, WI - about 2 years ago.

The obvious legal route to relief is bankruptcy, but with "only" $6000 in debt, you might want to start by exploring non-legal options, like credit counselling or other debt relief agencies that can sometimes help renegotiate what you owe. It sounds like you should also look into medical assistance. One legal thing to keep in mind is that you should differentiate between the emotional aspects of debt problems, which make you feel bad but have no relevance in court, and legal tools debt...

Can an officer breathalyze a person in a car whish the driver blew a 0.000?

Asked by a user in La Crosse, WI - over 2 years ago.

I am assuming you got an underage drinking ticket, as that is the usual way a person gets in trouble for having alcohol in his system while riding in the back of a car. Can you get out of this ticket? Maybe. If the officer lacked probable cause to order you to take a PBT, perhaps the evidence can be suppressed. If you consented to it, or made admissions about drinking, maybe not. Assuming you can't beat it, there are possibly diversion programs a lawyer can get for you depending on your...

What exactly does primary placement mean? 13 yrs married, <2yrs on mortgage left, he owns business, (which I dont want)He wants

Asked by a user in Onalaska, WI - over 2 years ago.

To answer your questions I would need to know more about your situation and the current status of the divorce. Your "rights" are to one half of the assets of the marriage, as well as one half of the debts. That would include the business. You don't have to run it or keep owning it, but he would have to buy you out. Joint custody of any children is presumed, unless there is a reason to do otherwise. Custody involves the right to make major decisions. Placement is more like the child's...

I was given a underage ticket in Wisconsin. The cop did not allow me to give a breathalyzer. But wrote 2 cans beer, verbal.

Asked by a user in La Crosse, WI - over 2 years ago.

It sounds as though you admitted to drinking? If so, that is the evidence that will be used to show you consumed alcohol. It might be the only evidence, which just shows how important the "right to remain silent" is. Remember that since you are underage, it doesn't matter how much you drank, only that you were drinking at all. If you were not drinking at all, you may want to fight the case and take it to trial. You will want a lawyer for that. If this is your first ticket you may be...

I want to create a document which would hold up in court and be legally binding

Asked by a user in La Crosse, WI - about 1 year ago.

If you want something legally flawless, you'd need a lawyer, but you can do it yourself and achieve pretty acceptable results. you'll just want to put into the paper what you and she are agreeing to, why she agrees, and whatever other terms are important. An inexpensive shortcut would be to file a small claim against her. you can get the forms at court. if you fill out the form and pay the fee (around $170), they will set a court date. if you show up and she doesn't, the court will give you a...

Does the insurance company have the final decision on liability?

Asked by a user in La Crosse, WI - over 1 year ago.

They can offer anything they want. They can hope you don't get a lawyer. They can be wrong. Don't go it alone. Chris
